Letter before Action newbie 10th Aug 18 at 9:35 AM
    Hello everyone.

Last August '17 I parked in a car park not in a marked bay. It was a free car park outside a Tesco Express. No windscreen ticket or anything.

In APRIL '18, i.e. months and months later, I received a letter from Euro Parking Services, with a photo of my car parked out of the bay, saying that they had written to me previously and the fee was now 160. I had definitely never received a letter from anyone about this.

I ignored the letter at the time, probably a mistake.

I now have received a LETTER BEFORE COURT ACTION requesting 160.

    Which route/letter do I appeal on? #

    Thank you

At the top of this board is a thread that tells Newbies to read it first. In that thread there is a section devoted to the court process. It ranges from responding to LBA's to defending claims.

You need to read it carefully.

This is Euro Parking Services (same outfit as in Ambulancegate) operating outside of another Tesco!
We cannot provide you with a silver bullet to get you out of this. You have to be in for the long run, and need to involve yourself in research and work for you to get rid of this. It is not simple. We will help, but can't do it for you.

Give a man a fish, and you feed him for a day; show him how to catch fish, and you feed him for a lifetime.

The letter is from Euro Parking Services.

I had a read of the newbie documents but became a little confused...! Didn't know which direction to take.

I never received a notice to keeper so should I appeal on that line?

Or is it too late now that a letter before court action has been issued?

I definitely didn't receive anything in the post in 2017.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    http://parliamentlive.tv/event/index/2f0384f2-eba5-4fff-ab07-cf24b6a22918?in=12:49:41 recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Throughout here you are advised never to reveal who was driving

You need to edit your op to remove details of who was driving

The ppcs monitor this forum and can use your posts against you.

The post you have been directed to in #6 covers how to deal with the letter you have received

James is not my real name. The only identifying information is Tesco Express and the offence date of August 17, with a letter August 18. Looking through this form there are hundreds of others in a similar case.

If someone from EPS is reading this- you're a bunch of.....

    You have identified the driver.

Use the third party to explain what happened as in " the driver did this/ the keeper did that..." etc

    Youre on here for advice
Someone with over 30,000 posts tells you clearly what to do, I'd suggest doing it and not arguing.

The reason why I wasn't in marked bays was because it was raining and there was poor visibility (had my lights on and you could even see a camera flash reflection on my bumper at 12:50pm in the afternoon and this was in jan, in the middle of winter).
I genuinely did not know I was parked out of bay and I was there for 5 minutes maybe under.
