    Hi all.. I don't know how to start to a new thread but i am having a similar experince with moriarty law....in september and octiober 2012 i took 2 payday loans out by lending stream and the payments were directly taken from my bank..via my card....moriarty law are asking for double the original amount.... I have bank statements showing all transactions for and from lending stream and have sent these to them... they keep getting back to me saying these payments are not associated with the accounts stated....its getting beyond a joke now as my bank statement cleasrly shows payments to lending stream..... cananyone help me with this please? thanks in advance

    Could you tell us what it is you have received from Moriarty Law? Is it just a letter stating you have outstanding loans from Lending Streams? Have they provided a statement of account or reference numbers?


    If they say the loans do not tally to the ones you have shown them on your bank statement, when do they say the loans were taken out? And is there a possibility the loans are statute barred (where they have run out of time to obtain a CCJ)? Be careful not to acknowledge the debts are yours in writing as this could affect the debts being statute barred.


    You could start by sending them the Prove It letter, to put the onus on them to prove these are your debts. You can find a sample letter here https://forums.moneysavingexpert.com/showthread.php?t=2607247.

    i i got letter stating pending proceedings with a form.....on the letters it has the ref no and original amount and date of agreement... which interesting does not tally with my statement .. obviously i paid interest but it still doesn't match up... the only thing that matches up are the dates....i showed them the credit statement of my bank account showing this .... plus the agreements were 29 sept 2012 and 14 oct 2012 so not quite there for statute barred... the payments they took out do not have a reference number showing on my statement but clearly sow lending stream and this was for the month after were they took the full amount plus interest according to the agreement on both accounts and moriarty law are asking for proof of payments with the account number.or payment. the bank cant do anything to help wit it being so long ago... i was lucky to be able to get my statements through history search on my transactions...thanks jo

    ok i may have a problem.. i did send my bank statement credit showing the credits from lending stream on the dates they mentioned but my amounts are more tan what they state so just does not tally .. ie on mine I have the first one at 150 credit .. then the second one in oct for 180 credit (i obviously paid interest on these too) but then moriarty law are saying the original amount with agreed interest is 127 and then 176 so that would mean the loans taken out were 100 then 150 (plus agreed interest) so either way their accounts are wrong.. but does this mean that because i sent the statements event though the credit amount does not match up that i have agreed to tat debt even tough i ave said i paid these amounts off? and dispute the debt (the amounts they want now are double due to their accumulated interest as alleged non payment)

    You mention the letter refers to pending proceedings and that there is a form. Is it a letter before claim that you have received? This warns you the company is considering court action. The form gives you the options to admit to the debt and make an offer, dispute the debt, ask for further information or ask for time to seek debt advice. It gives 30 days to respond.


    If it is a letter before claim it is very important that you respond within the time allowed, and it's recommended to send it back by recorded delivery. You can find a guide on how to complete the form here https://debtcamel.co.uk/letter-before-claim-ccj/


    You may want to consider asking for a copy of the credit agreement, and challenging them on what loans the payments on your bank statements do relate to if they say they are not the ones they are chasing you for. It would be a good idea to get in touch with one of the free debt advice agencies for more detailed advice, and you can request time to do this on the letter before claim form.

    hi yes it was the form you are saying... i did get in touch with them via email.and ave resquested what they relate if not those accounts .. im waiting for a reply
