Gladstones LBC received 26th Jun 18 at 11:41 AM
    Hello everyone,

I have received a LBC today for 4 PCNs from January 2017 asking for 130 pounds each (from 70 initially). I have received some debt collector letters until June last year, after which they stopped. I did ignore all of them though. I know you advise not to ignore, but I can't change that now. I have read the newbie post although I'm not sure on how to proceed, as some of the letters templates state that 'I have requested evidence/I have tried etc.' I am not willing to pay 520 pounds to these abusive scammers, or at least not without me fighting it. I have no idea what to do or how to write a defense but I am willing to dedicate my time to do it. I just need your guidance on what the steps are.

Edit: if it helps, I have pictures of how only parts of the parking have signages stating they charge you 70 pounds. (from the location where my vehicle was parked, they cannot be possibly be seen)

    Which abusive scammer was it?
If you want to win - avoid losing first. Here are a few examples
    1. Failing to RTFM - the Civil Procedure Rules
    2. Failing to Acknowledge or Defend- See #1
    3. Failing to RTFCL - the Court letters
    4. Template defences that say nothing - See #1
    5. Forgetting about the Witness Statement - See #3

Go to the Newbies link to see what it says about LBC and how to deal with them.

Horizon are not big on doing court but multiples get them excited especially if they think they are dealing with an abusive parker.

What is the background to 4 tickets and are there any more than 4. Sometimes they have a punt with some and have others in the pipleline.

They all happened in the Sainsbury's parking lot, in a particular zone. Before these letters, I had no idea about PCNs or anything related to them. The driver used to eat and do some university work in the Sainsbury's cafe. Also, they are all from the same week. Obviously, after the first PCN the driver stopped eating or going to the shop at all. In the following days, I have received the remaining 3. Hence, there are only 4 of them.

To whom does the LBC tell you to pay?

Does the reference number commence 1xxx, 3xxx, or 4xxx?
Please note, we are not a legal, residential or credit advice forum, rather one that helps motorists fight private parking charges, primarily at the 'front-end' of the process.

I prefer using estoppel with these. See the BPA Code of Practice

18.11 Where there is any change in the terms and conditions that materially affects the motorist then you should make these clear on your signage. Where such changes impose liability
where none previously existed then you should consider a grace period to allow regular visitors to the site to adjust and familiarise themselves with the changes.
The issue is clarity of signs. It may be the signs were there and you failed to spot them, realising your mistake when the first ticket arrived. Or in the alternative, Horizon were new on site and failed (under the code) to make the restrictions apparent.

    Go for both arguments.

    2. Failing to Acknowledge or Defend- See #1
    3. Failing to RTFCL - the Court letters

    Hello guys, I am back.

Today I have received my claim form. I have 14 days to respond with an acknowledgment form and 28 days to send my defense. What now?

I must admit I was not expecting them to make a claim. I am in over my head here. Thanks in advance.

When you think about what the average regular shopper spends at a supermarket per month it could easily mount up to 500 per month with petrol etc. Over a year that's 6000.00 and over ten years 60,000. I have used this example on occasions when I have had cause to complain.

As Quentin says plus the issue of estoppel.

Start sending Subject Access Requests for the pics. Also ask for a copy of the agreement between them and the landowners, copies of the site layout and when the signs were placed (important) and copies of the actual signs. Make sure you have proof you asked as you'll be going for a strike out at the DQ stage.

With an Issue Date of 6th August you have until Monday 27th August 2018 to do the Acknowledgement of Service.

But there is nothing to be gained by waiting.
