smart parking 15th May 18 at 8:37 PM
    Hi all.
Received a pcn from smart parking, still have the parking ticket that was purchased on the day.The only reason it could be, is the wrong letter inputted for reg 0 instead of o.Is it still worth contesting?
    Thanks

Likley reject, you go to POPLA and win
Or MART get smart and cancel now, as they know they will lose.

just looking at the pcn and the date o contravention is 11/04/18.
The date on the letter head 9/05/18
    Arrived by post 12/05/18
Should it have been received in 14 days?
Would this help if i have to appeal again?
    Thanks

That just means that they cannot hold the keeper liable.

That in turn means that it is very important not to give away the identity of the driver.

I have no idea why people fixate on the dates. No need, it's non POFA anyway, regardless.

The keeper will win the appeal by not saying who the driver was - easy!

I say Smart will give up first time, just with the forum template, unaltered:

PRIVATE PCN? DON'T PAY BUT DO NOT IGNORE IT TWO Clicks needed for advice:
Top of the page: Home>>Forums>Household & Travel>Motoring>Parking Tickets, Fines & Parking - read the 'NEWBIES' FAQS thread!
Advice to ignore is WRONG, unless in Scotland/NI.

How did you send the appeal to Smart?
Did you include your name and full postal address with the appeal?

If you didn't supply a postal address I fear you wasted that appeal opportunity.

As for "Can't remember what I wrote on the form...", I find it amazing that you didn't keep a copy of what you sent.

Why would i need to send my postal address, they already have it as the pcn came by post? And when i filled in the online form i thought it was sending a copy to my email address.

Perhaps another letter to Smart asking them to cancel again. Point out that their MD and CFo have been removed from office for unspecified behavior. You have the honestly held belief that this behaviour was falsely issuing parking charges and abusing the personal information of drivers.

See what they come back with.

The issue here is IF they want to go to court, they have to rebut your beliefs. And as they basically don't know what the hell has gone on at Smart ("independent" investigation ongoing), your guess is as good as theirs.
If you want to win - avoid losing first. Here are a few examples
    1. Failing to Acknowledge or Defend https://forums.moneysavingexpert.com/showthread.php?t=5760415
    2. Template defences that say nothing https://forums.moneysavingexpert.com/showthread.php?t=5818671&page=5#86
    3. Forgetting about the Witness Statement

    Letter received today from smart.

We have noted the points you raised and would like to confirm that we are cancelling the parking charge notice.

despite being thick it seems they know when they are on a sticky wicket, unless their recent managerial losses have caused some shake up given the new 2018 BPA CoP plus the impending Private Parking Bill that will see changes in this sc@m industry

they must have read the IPC CoP and worked out what "de-minimis" means

end of story for now, but dont get complacent as these various sc@mmers infest thousands of car parks in the UK and issue over 5 million tickets per annum
