Appeal payment Confusion ESA 12th Apr 18 at 10:13 AM
Long story cut short - going to appeal for my ESA so at the moment being paid the assessment rate of 73.10 a week. I was in the support group and I also receive PIP standard rate, I also was getting a payment for living alone with no carer, (not sure what it's called) but some premium payment. The DWP have told me that I am not allowed this whilst waiting for my appeal, so although they backdated my flat rate ESA the other payment has been taken away. I have read of other people who are still receiving that part of the payment - so, all in all, I am completely confused and upset with it all.

If someone could please clarify for me, before I spend hours waiting to get through to them on the phone.

    Thank You.

    See 2nd reply.

    And more info here:

And also this on yourable from a very knowledgeable poster, who also posts here:

"Disability premiums are paid when on income related benefits.
If you were entitled to the severe disability rate when you were on the assessment rate of ESA then you should still have received it when you were on JSA (if you still meet the eligibility requirements) and you should still receive it after you have lodged your appeal as you will again be on the assessment rate of ESA.

I do no know why you didn't receive the SDP whilst on JSA? Have your circumstances changed? Or are you muddling the premiums? or have I misunderstood?

Here's a link about the premiums:

    http://www.entitledto.co.uk/help/dis...ms-in-benefits

Only the enhanced disability premium and the severe disability premium is paid with ESA."

What the DWP have told you is incorrect.

Thanks Alice, I did not sign on for JSA whilst appealing, I truly could not face it so I just waited until I got the MR result back, then submitted my fit note and started from there.

    Much appreciated.
