Nightmare Landlord Withholding Deposit 8th Apr 18 at 9:31 PM
I am posting this on behalf of my brother who is at his whits end. He moved out of a rented flat about 4 months ago now and this is still ongoing.

He moved out of this flat leaving it in spotless condition, photographs on his phone showing everything spic & span including the oven, cupboards etc & the letting agent was happy with the condition of the flat. Next thing, he is informed that some of his deposit is being withheld because of "dust in the bathroom extractor fan" and some other ridiculous claim. The letting agent advised him to raise a dispute because this wasn't reasonable. Since then, the landlord has had an inspection of the flat carried out & returned pictures showing the place filthy! They are now claiming for this as well. The dispute continues...

Is there any advice people can offer here? Both sides are now claiming completely opposite scenarios, the landlords being fake

Make a claim via the relevant Deposit protection scheme. That is what it is there for.

You should have been told which deposit protection scheme your deposit was protected with, login and make a claim for the full amount of your deposit.... The landlord has 10 days to respond, if they put in a claim for some of the deposit then you have a chance to dispute this claim... At which case it is mainly up to the landlord to produce evidence and the independent deposit scheme will make a fair decision..

If your deposit was not protected I would just tell the agent/landlord they should give you the full amount or you will make a claim for the deposit plus 3x the deposit for failing to follow the law and protect your deposit.

The deposit protection scheme was setup to protect tenants....
