    I purchased a pair of boots from Jones Bootmakers online on the 22nd February using my credit card.

    On the 26th February the company went into administration and was bought by Pavers. I subsequently received my boots on Wednesday 7th March, and was informed politely by the Pavers customer service team that if I had any issues (sizing/colour etc) I could return the boots to a local Jones Bootmakers store for an exchange, but no refund would be given.

    The T&C's made with Jones Bootmakers were that I would be entitled to a full refund within 28 days if the purchase was unsuitable. Am I still entitled to a full refund?

    Prior to receiving the boots I contacted Pavers to ask that the purchase be cancelled but as the boots were already at the distribution centre I was told this was not possible.

    Pavers view is that the contract was made with Jones Bootmakers, but as Jones went into administration, the contract does not exist and as a gesture of goodwill they will offer an exchange, but no refund.

    As Jones still exist on the high street I would like to hope that I could still get a full refund, rather than an exchange? These boots were expensive so I stand to be out of pocket by almost 90.

    Any advice would be appreciated. Thanks.

    You aren't entitled to anything as the company you had a contract with doesn't exist anymore. They may use the same name in the High St but they aren't the same company.

    How much were the boots? If 100+ you could raise a Section 75 claim against the card provider.

    Unfortunately, that's the way it is. That company has gone bust owing lots of people money (including you, if you return the boots).

    As they have no money left, they couldn't give you the 90 even if they wanted to.

    An administrator will try to raise some funds to pay people by selling the assets of the business. So if you return the boots, and put in a claim to the administrator for 90, you might get a percentage of the 90. (It might be 20, or 10 or 1 or 50p or nothing - who knows?)

    So your best bet is probably to keep the boots (or exchange them).
