    Hi all,
    Just wondering if anyone's been in a similar situation. I own a flat in a building of 2 flats. The 2nd flat is owned by the housing association who are also the freeholders. The 2nd flat has been empty for a few months if that makes a difference. I'm wondering whether I can purchase the freehold, either for the entire building or a share of the freehold for my flat given that the other flat is owned by the HA who owns the freehold?

    It doesn't sound like you have the right to collective enfranchisement (i.e. the right to compulsorily buy the freehold) - because 2/3rds of the flats would need to be owned by qualifying tenants.

    You could still ask the HA if they would voluntarily sell you the freehold of the building, but to be honest, I think that's very, very unlikely.
