    So if I got married would my husband be entitled to half of my flat if anything went wrong?
    It's registered on my name, Iv paid for deposit and all payments and pumped 10000 into my flat since.
    I know that when your married things get spilt 50/50 if you get divorced but would I need a prenup to protect my property?
    This is a selfish question but Iv worked to hard to risk everything.

    In Scotland, despite the enforceability of a Prenuptial Agreement never being tested in the Courts, they are universally regarded as legally binding on the parties. This is due to Scottish legislation specifically providing that any Agreement entered into between two parties to a marriage in respect of financial provision of divorce will be legally binding unless it can be established that the Agreement was unfair and unreasonable at the time it was entered into.

    Funny how every day, there are many men getting married to partners when they've already secured a house and the vast majority of them just accept that it means the potential of losing their home in the future, especially if they have children together, but the moment it's a woman in that situation, there's an argument that she's worked hard to become a home owner and therefore should be able to secure it even in marriage.

    Most people who become home owners had to work hard in order to be in that position, women and men.
