    Hi,

    The driver of the vehicle parked in a permit car park without a permit. Consequently, upon returning to the car, the driver found a Parking Charge Notice on the side window. The PCN was served by a company called Spring Parking

    The driver parked in the bay due to its proximity to the workplace. This is due to awaiting a phone call from the hospital due to his mother being terminally ill and may have to get away from work quickly.

    The keeper and driver will appeal this PCN as a note was left on the car and a contact number in case it needed to be moved which was ignored.

    Spring Parking are a member of the BPA and it is understood from reading the forum, that an appeal to spring parking will be lost and also an appeal to POPLA will be lost. The appeal would be done using the templates on this site. The keeper will leave the appeal to the last minute as the forum suggests.

    As the vehicle was parked in a permit zone without a permit, would the keeper and driver have a leg to stand on at all. According to the driver there was adequate signage but the driver chose to take the chance.

    The landowner will not help in this matter as the driver was told "it's at his own risk"

    Any help would be appreciated.

    The keeper has a permit to park there. The keeper doubts that "the permit fell off my windscreen" would be a credible appeal to Spring Parking, could it help with the Popla one?

    Your opening post seems to say you have already appealed to Spring?
    Is that correct?

    If so, then wait for your PoPLA code and follow Pogofish's advice.

    Today, keeper received the NTK in the post. The keeper forgot to appeal the initial PCN given to him by the driver due to unforeseen circumstances. The keeper will appeal using the newbie template now regardless of going over the appeal time so as to receive a POPLA code

    If the keeper has a NtK, they can appeal the NtK. that will not be out of time.

    As expected, the keeper failed the appeals process through spring parking. Funnily enough they didn't answer the question below:

    Does your charge represent damages for breach of contract? Answer yes or no

    They did provide the keeper with a link to view dated photographic evidence. The keeper as previously stated has a permit to park there, but this was not on display looking at the photographic evidence. Should this be included in the POPLA appeal?

    Silly question, as the keeper, not the driver, on the POPLA new appeal page, it asks if the keeper is appealing on behalf of someone else. As the keeper, am I appealing on behalf of someone else (re the driver) or appealing on behalf of myself (the keeper)

    The keeper is appealing as the keeper.

    These trick questions are designed to get you to reveal the driver's identity. Resist them.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    Silly question, as the keeper is starting a new appeal through POPLA, under the short summary, is this where the appeal goes or should the keeper say please see attached file and then put the full POPLA appeal in a word document and attach it?
