Indigo ARE still getting details from DVLA... 8th Feb 18 at 5:41 PM
I received a Penalty Notice from a Railway car park, issued by Indigo Park Solutions.
On the Newbie pages, one of the Q&As indicates that "Indigo are not requesting DVLA data for these. Therefore, ignore a windscreen penalty from indigo (only if the location was a railway car park) and wait and see if they issue a notice to keeper at all. Then if they do, appeal as keeper using the template below. It seems likely you will hear nothing, in which case, do nothing."
I did nothing initially and have today received a Notice to Owner!!!8230;.
The advice on the Q&A is to appeal. My question is, should I use the TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING template?
ps I today contacted the DVLA with a Vehicle Subject Request.

You'll find that link on pretty much every other thread.

    Here it is again:
    http://parliamentlive.tv/event/index/2f0384f2-eba5-4fff-ab07-cf24b6a22918?in=12:49:41

The 'x' on the end has thrown it.

The Deep would probably argue that one little 'x' on the end is de minimis.

it has been shown over and over again that in railway cases , INDIGO are NOT getting info from DVLA , they are letting ZZPS do all the work

Should have a definitive answer on Saturday re Indigo and accessing DVLA data. The subject access DVLA email should work PG, I used that for vehicle keeper data and DVLA said they can't reply by email but have sent info to RK address 1st class mail. Away until Sunday, but on Sunday will find out who accessed my data for an Indigo managed car park and an Adaptis request for money. It can't be Adaptis - they're not ATA registered! My guess is Indigo are accessing.

Clearly either Indigo or the DVLA were being economical with the truth when saying they were not requesting keeper details. Oh well .....seems to be par for the course. The DVLA has told me magnificent whoppers in the past (and yes, I do have incontovertible proof).

As usual, Indigo are mixing up contract and byelaws terminology. The penalty notice is all about breach of the Byelaws - yet the request to the DVLA was for breach of terms and conditions of parking. A byelaw is a rule laid down by the State - nothing to do with terms and conditions which can only apply in a contractual context.

Apart from that the requests seem to be OK. It's what Indigo do with the data afterwards that is unlawful.

Make the same complaints that you see suggested on all the other Indigo threads.
PRIVATE PCN? DON'T PAY BUT DO NOT IGNORE IT TWO Clicks needed for advice:
