    PCN for "no stopping"

PCN for "no stopping" 7th Feb 18 at 5:37 PM
    Hi... Any advice appreciated please.
I got a PCN from Vehicle Control Services for stopping in a No Stopping area at: Calder park estate roads Wakefield WF2 7UA. I hadn't been on any sites like yours before and maybe stupidly but honestly I appealed against the charge admitting i was the driver. It was needlessley to say dismissed by return email from not from VCS but from Excel. My reason for the appeal was because i had suddenly become ill and was not fit to continue driving safely so i pulled over straight away. Within a couple of minutes i had recovered sufficiently to continue my journey. Obviously as i have now read on the forum mitigating circumstances mean nothing to them. I wonder if i had continued driving and caused an accident whether i would have had a case against them for not allowing me to stop for fear of penalty.
Do i need to pay up or would i have a case if i refuse and they take me to court.

depends on the circumstances, the total time stopped , the signage , the landowner contract and the judge on the day

nothing is guaranteed for either side

the advice from us would be IGNORE and come back if they issue an LOC or a court claim (MCOL) within 6 years

Private Parking ticket? check the 2 sticky threads by coupon-mad and crabman in the Parking Tickets, Fines & Parking Board forum for the latest advice or maybe try pepipoo or C.A.G. or legal beagles forums if you need legal advice as well because this parking forum is not about debt collectors or legal matters per se

As above - ignore anything further other than a LBC or MCOL Claim (see NEWBIES FAQ sticky, post #5 for acronyms).

You may have to go to court to defend this (with significant help from this forum), but the writing is on the wall for the PPC network in the wake of the Sir Greg Knight Private Members Bill, debated in the House of Commons last week - do a Google search and read the transcript.
We cannot provide you with a silver bullet to get you out of this. You have to be in for the long run, and need to involve yourself in research and work for you to get rid of this. It is not simple. We will help, but can't do it for you.

Give a man a fish, and you feed him for a day; show him how to catch fish, and you feed him for a lifetime.

Do i need to pay up
    No.

or would i have a case if i refuse and they take me to court
    .
Yes, especially as VCS use BW Legal, who muck up claims and are fairly easy to beat, with some time put in to research & carry through a strong defence.

Don't pay. Come back if and when you get a BW Legal letter, or a court claim. No biggie.
PRIVATE PCN? DON'T PAY BUT DO NOT IGNORE IT TWO Clicks needed for advice:
Top of the page: Home>>Forums>Household & Travel>Motoring>Parking Tickets, Fines & Parking - read the 'NEWBIES' FAQS thread!
Advice to ignore is WRONG, unless in Scotland/NI.

Thank you all for the advice. So i sit on it even though i admitted to being the driver and the signs are clear. By the way, so are the pictures. I was stopped for 2 mins at most.
    Thanks again.

It wasn't in a car park.. It was on a road through an industrialized area. with " No Stopping" signs like on a Motorway. I did know but was in no fit state to drive for those couple of minutes.

The House of Commons had a second reading of a bill to curb these scammers last Friday, you can watch it here

    https://www.stepchange.org/debt-info/ccj/set-aside-ccj.aspx

Might I suggest that you give the pot a stir and tell your story to your MP
You never know how far you can go until you go too far.
