    Hi all
    Iím looking for some advice regarding how to get out of paying 2 PCNís issues by Smart Parking.

    Basically Iíve been using the same car park for many years and they suddenly changed the parking rules (used to be free on Sundayís, now itís only free for first 4hrs) and we only found out after receiving tickets in the post!

    After visiting the car park again to check, there are signs up. Have sent letters to Bella Italia and Cineworld (the premises we had been customers of) Bella have said theyíre not Ďaffiliatedí with the car parking company and canít do anything and I havenít heard back from Cineworld as yet.

    Iíve appealed both tickets using the template listed on the newbies feed - the 14 days expire on 13th and 15th February. Is it just a waiting game now? Is there anything else I can be doing?

    Iíd really appreciate anyoneís advice.

    ignore the early discount

    its a waiting game and they have 35 days to decide

    The BPA CoP covers the time to get back to you, and it covers changes in car parks with a suitable "grace period" in place to warn drivers about the changes , especially the signage

    smart parking are BPA , the code of practice states that they must errect clear and prominent signs to show a change in times/costs , was signage like that in place?

    Yes unfortunately on a subsequent visit it does appear that there are signs up, unsure how we managed to miss them (TWICE!)

    Perhaps you missed them as they are not clear and prominent enough?

    await POPLa code and state the signage had not been changed at the day of the incident

    None of the stuff about signs matters. A keeper appeals = a keeper wins v Smart.

    Main POPLA appeal point: ''no keeper liability'- non-POFA PCN

    second point (all of these are already written as templates in the NEWBIES thread):

    'the operator has not shown that the appellant is the individual liable'.

    Other points like signs and landowner authority then follow, just to rub Smart's nose in it.

    Hi guys, today is exactly 35 days from when I appealed the first ticket and Iíve not heard anything... is this good or bad? I presume they would write to me rather than email?
