    VCS vs HM Revenue (The Sequel) 5th Jan 18 at 12:39 PM
    As many on here remember, back in March 2013 the Court of Appeal ruled that VCS's income from parking charges was not subject to VAT.

    Well, following their defeat, the HM Revenue took immediate "revenge" by rejecting VCS's VAT repayment claim for the April 2013 quarter by stating; that following the Court of Appeal decision, VCS could only now claim 8% of the VAT back on their purchases and services, instead of 100%. (For April 2013 Quarter this meant 71,830 was disallowed.)

    VCS, (of course), appealed to the HM Revenue and lost, and then the 1st and 2nd Tier Tax Tribunals in 2015 and 2016 respectively, and lost on both further occasions. This still leaves them the option of the Court of Appeal, if they want.

    (The 1st tier judgement is slightly less boring to read then the 2nd!):-

    Good find. It's hilarious reading how VCS's attempt to have their cake & eat it too has been thwarted but the various appeals must still have cost them a bundle.

    Simple Simon poem
    Simple Simon met a pieman going to the fair;
    Said Simple Simon to the pieman "Let me taste your ware"
    Said the pieman to Simple Simon "Show me first your penny"
    Said Simple Simon to the pieman "Sir, I have not any!"

    Simple Simon went a-fishing for to catch a whale;
    All the water he had got was in his mother's pail.
    Simple Simon went to look if plums grew on a thistle;
    He pricked his fingers very much which made poor Simon whistle.
    He went for water in a sieve but soon it all fell through;
    And now poor Simple Simon bids you all "Adieu"

    So they were reclaiming VAT this entire time?

    It seems that VCS didn't actually understand how reclaiming VAT actually works. You can't reclaim it on purchases if you don't charge it down the line.

    I!!!8217;d say now they have this , they should loo, to reclaim vat reclaims for more years now. Clearly it was always exempt from vat, therefore ALL their returns are liable for reclaim.
