SIP parking fine passed to Gladstones

SIP parking fine passed to Gladstones 17th Jul 17 at 11:32 AM
    Hello,

I'm looking for some advice on how to proceed with a parking fine I have received.

I parked my car and paid for a ticket, displayed it on the dash, it was a windy day and when I got back to the ticket was in the foot well and I had received a parking ticket. This was in a SIP carpark in Manchester.

I discussed this with some work colleagues and was advised to just ignore it. I have so far ignored the letters from SIP. I have not responded to any of them.

I have now received a letter from Gladstones advised I will be taken to court if I do not pay £160 within 14 days.

I still have the parking ticket that was displayed on the dash so have proof that I did indeed purchase a ticket to park.

I am unsure how to proceed next.

Many thanks in advance for any help.

The rules change on 1st October when issuing a claim becomes far more tiresome, so keep the ball in play..

Do I need to reply to this letter or just await court papers?

Give THEM 14 days to reply and tell them they cannot proceed to a claim at a stage where discussions are ongoing and they have failed to supply facts and evidence about any contract/signage or breach.

They have sent photos however these are not dated. They have not included a picture of the signs. After reading their letter several times now, I am questioning if the letter is not standard reposted they send to everyone. It includes paragraphs about issues that I did not raise. They have also not specifically answered some of my questions.
I plan to respond with a robust reply requeting pictures of their signage.

    Hello again,

I wrote back to Gladstones requesting the information they did not include on their original letter. I obtained a certificate of posting. Today I have now received court papers. Is my only option now to prepare my defence?
I was issued with my original parking ticket due to the ticket blowing out of my windscreen due to windy weather. I have the original ticket as it has fell into the footwell. I'm not sure if this is defendable?

Thanks in advance for any advice offered.

Defend it. Your ticket will be great evidence.

How to defend is explained in the NEWBIES FAQ sticky, post # 2. Use that as your guide.
The fact that I have commented on your thread does not mean I have become your personal adviser. A long list of subsequent questions addressed for my personal attention is unlikely to receive a reply.

I suggest you have a look at my 'flipped ticket' thread for an example of a defence for your case. I submitted it recently. Hope it helps->

Claxtome's wording is the one to adapt/use, for a defence and later in a WS.

    Hello again,

My case is still rumbling on (from Feb 2017)

I!!!8217;ve had to chase things up, I!!!8217;ve now had a letter from the court -

It states the judge proposes to dispose of the case without a hearing that is based on the papers alone.

Gladstones have replied that they wish for the case to be heard on papers alone

I!!!8217;m not sure how to proceed, is it best to have the case heard in court so I can defend myself and show the ticket I purchased?

Many thanks in advance for any advice

Read the NEWBIES FAQ sticky, post #2 where there is expert advice about how you deal with this part of the process, and in particular the issue of your case being heard on the papers (not recommended in most cases).

I have a similar case but due to sunlight an a gentleman infront if me I entered my VRN on the keyboard I couldnít see the screen and it printed GGG I appealed to hx carpark who basically said they know I had bought a ticket within two minutes of arrival and left well under the hour I paid but as I had not given the correct VRN on my ticket this breaches terms and conditions of parking on this site.
Received lbc from Gladstoneís can I win this or do I pay it? Iím really worried. I still have my original ticket

Do you have written confirmation of that HX acknowledgement?

    @Willow229

Is your local court Manchester? If it is papers only would be OK

    @Hel3013

Same question but best start your own thread.
If you want to win - avoid losing first. Here are a few examples
    1. Failing to Acknowledge or Defend https://forums.moneysavingexpert.com/showthread.php?t=5760415
    2. Template defences that say nothing https://forums.moneysavingexpert.com/showthread.php?t=5818671&page=5#86
    3. Forgetting about the Witness Statement

I have a reply from hx refusing my dispute as they only allow 2 digits for error. The letter from Gladstoneís is a lbc so doesnít state a court yet. I donít know if to call them or write I think I should write but need a template as Iíve already admitted it was me but made a mistake on machine but paid and had valid ticket. I have since sold the car.
When I say read #2 what does that mean as I spent hours on here the other day back and forward looking reading and trying to work out as a newbie, sorry Iím usually quite good with the internet and researching etc but Iím confused with forums!!

I!!!8217;m unable to find the copy of my written appeal but I have Hx response. wording of the appeal states in short we have considered and reviewed in conjunction with the evidence we have gathered. Our records show that pcn was correctly issued. Extended discount period by 14 days.
As you stated in your appeal you entered the registration GGG as this is not the full or correct registration of your vehicle it is not considered valid payment. The car park uses APNR cameras so no warden would have seen my note and I should have telephoned should you have a problem. (I can go back and check these signs but there wasn!!!8217;t a telephone number to ring customer services on the first letter I received)!!
Our appeals process is now closed then the usual speil after that. Glade stones letter says letter before claim is this letter before court action?

Hel3013, are you bothering to read the responses you are getting to your posts?

Twice now you have been asked to start a new thread if you need help.

It is extremely discourteous to hijack a thread in the way you are.

Please delete your posts from this thread and start a new thread if you are looking for help.

    Thanks.
