    Hi,

    I don't post a lot here, but I need a bit of advice.

    I live in Scotland and the DRP letter is for a charge in Scotland, if this makes any difference.

    Today I have received a letter from DRP (Debt Recovery Plus Ltd) regarding a non payment of a parking charge from NCP.

    They first paragraph states that NCP have written to me and I have not repaid the parking charge.
    This is actually false, I have never had any correspondence from NCP whatsoever.

    Second paragraph states a landmark case 'test case' and have provided a link - supremecourt.co.uk (slash) cases (slash) uksc-2015-0116 - you get the idea
    I am not sure why they need to provide this paragraph, is this meant to justify thier claims?

    Third paragraph asking for payment of £149.00
    very excessive I think

    Fourth paragraph states I need to pay by 9/9/2016 or they will recommend to the creditor that court action should be taken.
    Would they take someone to court?

    I have read a lot regarding this and I am confused, some say appeal, for popca (or something like that), some say ignore...

    I am kind of worried about this as I was someone who was in a lot of debt and had to go into a DAS (scotland) (in hindsight due to PPI) and successfully completetd it. This left my credit rating extremely bad for years. But I have now got all of that sorted and I do not want to have my credit rating messed up again.

    Please could someone give me advice on what to do with this DRP letter.

    The Practice Direction on Pre-action Protocols and Conduct also requires that they supply to you all of the documents they intend to rely on in court. I'd just bet a pound to a pinch that those letters contained nothing more than fresh air and what's more I suspect that DRP wouldn't recognise the PD if it was to jump up and slap them in the face. Much like other debt collectors they spout unadulterated BS in the hope that it sounds impressive enough to frighten some people into paying up.

    As I have said many times before the HO87-ettes (all now well into adulthood) found that shredded debt-collector letters made excellent hamster bedding.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

    "It is our intention to collect this debt and pursue it to a legal conclusion if necessary"

    why add if necessary?? the last lot said they were advising NCP I be taken to court. why are they sending to another company?

    We are prepared to accept a reduced settlement figure of £79.00 to avoid possible necessity and expense of legal action

    We urge you to act now to take advantage of our discounted settlement offer of £79.00


    I am now never going to accept this and will welcome a day in court if that is what they want... I will keep all of these letters from debt recovery agencies as the fee they are asking for is astronomical and I wont pay.

    I will however never in my life use an NCP car park ever again...

    On a side note: their Bank Sort code is identical
    RBS 16-00-01
    Accounts differ, but I bet these companies are actually the same company broken into smaller ones

    in fact in the small print it says:

    The Zenith letters mean DRP are throwing in the towel, that's why they have reduced their scam charge.

    wonder if you can put my mind at rest, only just got my first DRP letter and felt instantly sick! They mention supreme court thing too. But upon searching for other Scottish ones I came across your thread. how did it proceed? Should I just calm the !!!! down? thanks

    No of course it didn't and neither should letters from Muppets like Debt Recovery Plus, or the other desk in their office Zenith that can't do anything but send silly letters.

    I have not had a letter from any of these numpties since october 2016..

    In theory, they have 5 years (in Scotland) to pursue you through the courts.

    In practice.... ain't gonna happen.

    Did anything else ever come from this after them sending letters about court etc?

    I received a parking charge from Britania parking which was then passed onto DRP, i have ignored every letter because thats what i have been advised to do but the letter i received today says they will send it back to their client and “recommend” they take me to court! Do i just ignore this like the other letters?

    Im worried!

    If you have ignored everything up to now they still haven't a clue as to who the driver was - only the registered keeper.

    AFAIK up till now no keeper in Scotland has been taken to court for a private parking invoice - where the driver was unknown..

    This is pretty much the last letter you'll receive as they are on the verge of giving up on you.

    Do NOT reply to anything except a genuine court summons.

    In the odd chance (pigs will fly) that they do try to serve genuine court papers on you the keeper, come back here and there will be plenty people able to give advice as to how to make them look very stupid indeed.
