    Claiming against Norwegian Airlines

Claiming against Norwegian Airlines 17th Jul 16 at 11:50 PM
Thought I would document the progress of my claim as I can't see anything specific to Norwegian on here.

So we were 7.5 hours delayed due to a member of ground staff being ill. To date, long story short, they've tried to fob us off claiming exceptional circumstances and citing a case about a damaged engine, totally irrelevant!

I refused their offer of reimbursing our expenses of 60, found a case that went against the airline that has the exact same circumstance as ours, and have issued a Notice before action today.

Planning on taking this all the way myself as the NWNF solicitors would be taking pretty much half of the compensation.

Any advise welcome, especially regarding the small claims court, as it's going to have to be European Small Claims Procedure I think, can't see a UK address anywhere for them.

As recommended in Vaubans guide, I have given them 14 days to respond, so have a couple of weeks to do my research for the next phase. Thanks to those who have helped on here to date.

Here!!!8217;s my attempt to counter their rejection of my claim!!

The delay to my flight D81609 was caused by a delay to the incoming flight D81609 4 Nov 2017.

This delay was not caused by weather as you assert - please see below.

Aircraft B38M 737 MAX departed EDI 18:05 and landed at YUL 21:42 EDT

We were told there was a technical fault on B38M and it was diverted to YUL - records prove this

    Aircraft B738 737-800 departed YUL 23:14 EDT arriving 00:00 EDT +1 BDL

Weather in your !!!8216;network!!!8217; was not the reason for this delay - you changed the aircraft at YUL

I was expecting a 737 MAX to arrive rather than a 737-800 and gate staff confirmed there had been a technical fault and B38M was diverted to YUL. I also have the evidence that another customer was told exactly the same by your gate agent.

Within the Regulation and the case you quoted this is not considered to be an exception circumstance.

I have copied in the UK CAA and will raise a formal complaint if you fail to respond accordingly.

Perhaps a little change - correct term is Extraordinary Circumstance, not exception.

    Norwegian Airlines UK
Hope it helps a couple of folk that Norwegian Airlines are UK registered at Companies House and their registered address is:

First Point, Buckingham Gate, Gatwick Airport, England, RH6 0NT

which means they can be pursued via the UK route, I guess.

    Agree to compensation
After submitting my claim 5 weeks ago for 2 cancelled flights & re routing to another airport, Norwegian have accepted my claim under the EU261 directive.

I would find it incredible they didn't accept it but reading reviews by other passengers I was worried they would reject it just to be awkward with the hope I would stop the claim.

Just got to wait for the money, no doubt another 5 weeks!

Compensation payment received from Norwegian Air for the same flight cancelled twice & a re routing to get me home. From start to finish it took 9 weeks. I didn't chase them by sending follow up emails or letters. Relieved it's all over, I'm not sure I'd want to fly with them again trans atlantic.

    Hi

My flight home to the uk from the States was delayed over four hours due to late incoming aircraft. This should have entitled me to 600euros or whatever compensation.

I filled in the Norwegian air online form. They said 'extraordinary' circumstances, no explanation.

I filled in a couple quick flight delay checker forms with Bott and co or whoever, and they came back as me being entitled.

I wrote a letter to Norway before Christmas, and filled in an online contact form, stating EC261/2004 rules and the fact that late incoming aircraft is not extraordinary circumstances etc and they I'll be taking further action.

No reply to my letter, but again, said

    '
    Thank you for your response.

We appreciate that our response may not offer the outcome you were seeking, however we do trust that we have clarified the reason for the outcome of your claim. We certainly hope that this experience will not deter you from choosing to include Norwegian in any future travel plans.
Norwegian informs that you have the ability to appeal our decision through the national enforcement body of the country where the disruption occurred. Contact information can be found at the following website.... which was ec Europa but I can't post links
    Kind regards,'

I don't fancy handing over my claim, and therefore part of my compensation over to a third party, are there any other options?

moneysaverz83 I'm not sure what to do here. Delayed over four hours from USA to London in November. Apparently extraordinary circumstances, but was due to late incoming aircraft.

Filled in norweigan claim in December, came back as extraordinary circumstances, no explanation. Wrote to Norwegian air at Norway office, no response.

Constructed an NBA letter 3 weeks ago and sent it via their online form and contact form, got a generic reply saying there's nothing they can do, again no explanation of extraordinary circumstances.

Scrolled through their site, could not find any other uk contact address.

Sent the NBA to Norwegian air international limited in Dublin, and to their Gatwick office. No response.

I wanted to avoid going down the no win no fee route.

Is this my only option now?

you have issued you NBA so now you can start court proceedings.
Although you do not want to use a NWNF, have you put the flight details into Bottonline and EU Claim to check that they agree that compensation is due?

Ye I already did that and obviously it's just a basic checker, it came back as due competition.

I haven't used Bott and co for 6 years. They take a percentage don't they?

Brief look through the thread shows how pathetic Norwegian are.

Anyone actually have a SPECIFIC email and physical address for this type of thing? So I can try ONCE more before Bott.

Check their for registered business address in the UK. Issue/serve papers there, unless it's a P.O. address.
