Parking eye fine. 17th Jan 14 at 5:53 PM
    Hello,

I have been reading all the advice on this website and I am not sure what I should do or should not be doing. Up till now I have ignored such letters, but have received another letter from PE informing me that I have 14 days to pay 85. If i do not pay then further action will take place through either solicitors or court proceedings. They tell me I can appeal this.

Please help, am starting to worry.

    Thanking you in advance.

Glad that you're deciding to fight - we will help you!

The image resolution is too poor to actually read the text - can you scan a higher definition image?

As well as your name, blank out any reference numbers or barcodes.

cant read it , and its still got references on it from what I can see , and your reg number too

please cover up PE references etc as well as your details and reg number , take a clearer picture of it and try again

I would delete your previous picture in post 22 for now , or the post itself preferably

by the way, you do realise its an offence not to register your car with the dvla at your new address ? ie:- you should send the V5C off and change the address, same as your driving license etc if that isnt registered to your current address

ok, you said on the 18th jan that you sent in that soft appeal in post #2 by email

I assume you mean you did this online at the PE website ? , please confirm this

did you get any email acknowledgement saying they had received your soft appeal ?

I see from your photo that the date of the contravention was indeed 04 dec 2013

I was going to email the appeal, but actually sent the appeal by post on the 18th. They responded by sending LBCCC. I am thinking about sending this appeal again to their website....

You are still leaving information on the image that identifies you, the exact timing of the event tells them who you are, please read my signature below
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    OK,

I have deleted the letter, it was dated 12th Jan. The LBCCC was recieved today. If that helps.

My boyfriend used to work for a debt company and process claims through the courts. He says that Northampton County Court would fast track debt claims, do you think this could be the same here?

normally, PE would issue an NTK by post to the reg keeprs address within 14 days of the contravention so before xmas, you would be expected to appeal this within 28 days so if you sent in your appeal by post then I would have thought it should be within the time frame , although it may have missed the deadline and appears to have done so

I would not have thought you would get a LBCCC so fast after this missed deadline , they should have issued a refusal + popla appeal or cancelled the ticket

if you had receipts of being on that retail park in bradford then you should have submitted them with your appeal and they usually cancel the ticket for an overstay, which is what happened to my relative on a different retail park (as I reported on this forum)

so I think we can assume you received NO NTK , or it was received at your old address and binned and the letter you uploaded was a follow up letter

I thought you were redacting the second letter and posting a scan of it so we could see what it said

its my belief that you should have had a notice to keeper in decemeber, then had 28 days to appeal , they then sent you the notice you posted in january meaning you were past the appeal deadline so they were holding the RK responsible

earlier in the thread you said you had emailed the appeal, now you say you posted it, but time was of the essence when you actually appealed so it should have gone in online, but may have been out of time anyway

just strange how they went straight to an LBCC so quickly, maybe its a new trend ?

    Thank you for the advice,

I hate to say this but they have got the better of me, there is a lot of imformation to take in. I have 14 days to pay before they proceed with court action. This is starting to make me feel ill just worrying about the situation. Im going to speak with a manager from one of the shops tomorrow to ask for their help too. With this I will decide what to do....

I hate to give in but this is too much for me to deal with.

    2. Send an email complaint to the BPA and DVLA saying you got no reply to your posted appeal which was within 28 days of the PCN letter which you know arrived 'over Christmas' but has been discarded now as you had appealed and thought it was over. The email addies you need for the DVLA and BPA are in the sticky thread for NEWBIES, that's what all the advice is there for.

    3. Send the letter you have found by zzzLazyDaisy (the one you quoted above) but also add in copies of your receipts (keep originals) and add a paragraph to mention the driver and passenger were legitimate shoppers and you are disgusted at this treatment and have complained to the Store Managers on site. This was a particularly busy Christmas shopping day and cars were queuing in and out so obviously longer was needed than normal.

There have been 'over' (!!) letters but my mum has thrown these away.
Oh dear - you mean 'other' letters such as the original PCN with the photos on it, and then the reminder, in December. She threw them away, if so sadly, Mum has helped cause this headache for you now! December was when you should have appealed - but you can get this sorted out now instead with some robust responses sent TODAY.

thanks, just seems to prove my theories were correct, they have ignored debt collection and gone straight to LBCCC after you appeared to fail to appeal in their eyes (this being a new tactic it would seem, with you as the guinea-pig)

so you need to read what CM said in post #34 and do everything she told you to do, all of it, no missing anything out as I believe she gave you the best advice here based on my scenario. just seemed strange it went to LBCCC so quickly, still does too , but you have to deal with it in the manner she stated

had you appealed it in december 2013 and provided proof of patronage of the retail shops etc on that site, PE would likely have dropped it , so now you need a robust LBCCC rebuttal , this point 3 by CM now becomes that appeal that you should have sent before xmas , but do it in exactly the manner she tells you to

so they were the following 3 points

bear in mind that at this point you are trying to get a cancellation or a popla code to come back from PE (but you may get something else instead)

you are also trying to get the BPA and DVLA to investigate and again are angling for cancellation or a popla code

and you are trying to get the shops or landowner or managing agents to cancel the parking charge too

so ideally , cancellation, or a popla code , not court if it can be avoided

CM has managed to get another one turned to a popla code from imminent court proceedings by backing them into a corner had they proceeded to court and refused popla adjudication

    Evening all.

I spoke to a store manager about my situation, she phoned PK and cancelled charge. Should I expect to hear from PK ? Or dare I say it, is this situation all over with?

its never over until you get something in writing saying its over

so if you get a popla code or anything else, deal with it as if its "live" , even if it isnt
