Father in law died

Hi my father in law passed away last week, we went to the credit union to get his £5000 savings to pay for his funeral. But they said the money would be used to pay for his ccj. Is this correct

    Funeral costs normally take priority over other debts. Not sure about CCJ though. If there is not enough money the local health authority have to pay. They cannot force you to contribute or pay in any way. How much is the CCJ?

    Very sorry to hear about FIL but what funeral costs £6000 ? The Funeral Directors fees can be paid via the bank direct when you have their invoice; the funeral wake costs do not count.

    That's a lot.
    Local authorities will pay for a "paupers" funeral and will not pay for fancy car and tea and sandwiches.

    £6,000 is a lot for a funeral. A very basic cremation can be done for under £2,000.

    You need to be very careful here, administering an insolvent estate can land land you in trouble and unless it is done by the book the administrator can end up being made liable for the estates debt,

    Whoever arranged the funeral with the FD is responasible for paying it. They may be able to get some of it back from the estate eventually, but the creditors can justifiably argue that it is unreasonable to for an insolvent estate to have such an expensive funeral.

    Who authorised the arrangements?
    I am worried that the person that authorised this will end up paying.

    The term Public health funeral; is the current term and does not carry the stigma of a paupers funeral. It will be quite basic and usually cremation but perfectly respectful. Don.t expect many flowers or cars for mourners.

    Is the CCJ secured against the bank account? If not then AFAIK reasonable funeral cost take priority. It will be hard to justify more than £2,500 at the most. You need to check with the credit union and perhaps get urgent advice from the CAB
