Problem with a Flight Delay Company - How do I Escalate?

Problem with a Flight Delay Company - How do I Escalate? 14th Jul 18 at 4:02 PM
Slightly odd one this but would appreciate some help.
TLDR: How do I escalate against a compensation company that said I had a confirmed compensation amount in May 2017 but still have no money?

My wife signed up to use a company delayedflights.com in 2017 to pursue compensation for delayed flight (with Air Transat).
She received and email in May 2017 confirming the claim was a successful to the tune of about £2000 and they included the indication invoice of their cut.
Email said it can take 60-80 days to receive payment
But despite emailing them roughly every 3 months we keep getting fobbed off with comments like "we are unfortunately unable to match payment from the Airline yet....we only get paid when you get paid etc"

As it's now nearly 14 months later I had had enough so have looked to try to push matters with them only to find:
They no longer have a telephone number - contact is online only.
The T&Cs say details of complaints procedure "available on request"
So I sent a webform enquiry asking for the complaints policy (no reply).
I used their Facebook page only to kept being told it is for new cutomers and it use their webform.
They have clearly got my messages as they acknowledged I had been in contact via Facebook in a "we will review and get back to you" email to my wife a couple of weeks ago.

What are my options for escalating and pursuing this matter please?
    Thanks

    Same issue! Help!
    Hi guys,

I am in the same position... I contacted DelayedFlights.com back in May 2015. I was emailed in November 2016 saying the claim was successful and was happy with the result. This was followed by an email saying it would be paid out typically in 30-90 days.

I have had the same correspondance saying when we get paid ill get paid etc and has been back and forward until 2018. June was the last time I received and email from then.

I have since contact United Aiirlines via Resolver who have confirmed the compensation was paid on 16th November 2016 to DelayedFlights.com.

They do not reply to me now... what do i do?

    Thanks
    Aidan

    Hi Aidan,

Issue court proceedings via MCOL after you have sent them a LBA (Letter Before Action). Read Vaubans great guide for a 'how to' guide. See below here to find it.

For your information (and I know it's too late in your case), and anyone in a similar position. We have been advising potential claimants to only use a regulated flight delay solicitor, such as Botts, for a long time. More and more unregulated claims assistance companies are causing claimants huge problems, you only have to read the absolute misery they can cause innocent passenger in the following tread....
    https://forums.moneysavingexpert.com/showthread.php?t=5667325.

PLEASE DO NOT USE UNREGULATED CLAIMS ASSISTANCE COMPANIES.

They are not all rogues but some are absolutely disgraceful.

    Good luck.
Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.

As this business has not made up accounts in the past 2 years, has changed hands and premises several times over the past 4 years I am not optimistic you will recovber your compensation.
Small claims court is the only way forward.

    Thank you for the reply.

I am pretty clueless on this stuff.

Does an email count as Letter Before Action or does it need to be sent in writting?

Secondly, what is court action via MCOL?

    thanks again!

    Hi
I am glad you are starting to get sorted.
I have had the same issue with 2 flights for 4 people since 2017 and they havenít replied to me yet the airlines have both confirmed that they have sent them the money!
I know you had a lot of steps in the process I was just wondering if you could list what the final push was to get them to pay out. Thanks

1)get the airline to confirm they paid out - date and amount
    2) write to delayed flight with info and ask for money within 7-14 days or else you will issue small claims procedings
    3) the time will lapse so issue small claims procedings
    4) they will write to you saying you will lose but ask a gesture of goodwill offer you the initial amount promised plus a little more
    5) the cheque will bounce
    6) confirm to court the cheque has bounced and you want to proceed with claim
    7) have money direct debited into your account within the hour
    Hope that helps

Have the chronology clear as to what you tried when and also confirmation from airline as you will need this for the small claim application anyway

    Hope that helps

Hello. I have exactly the same issue with the same company. It is definitely acting fraudulently. The 29 year old who runs it has got to be ripping us off. Iíve contacted the financial ombudsman who are very busy at the moment but have acknowledged my complaint. The company weíre going to be struck off the register of companies house because they didnít submit their account but there appears to be an objection to it for some reason. Iím still fighting since July 2017. They also sent me an email saying the claim was successful. I contacted Flybe who wonít give me any information as I signed the paperwork for this idiot to act on my behalf. Thanks for posting. I see some light. Iíll keep updating if you like. I also contacted watchdog but they havenít got back to me. Iíll try a similar thing.

MW16, simply send a SAR Flybe's way. They will have disclose ANY information they have on you, including third party conversations where you have given them consent.

    Sorry to hear this MW16
I explained the situation to Air Transat including the email from him claiming they hadn't paid
I then issued court proceedings and that is what led to me getting paid (although note the last minute tricks too)

Forget the watchdog for now and just issue a small claims notice I would suggest

Hello all. I’ve completed the money claim which was ignored and so now we’re on the final days of the CCJ which I believe he won’t pay. It mentions being able to enforce the payment with debt collection proceedings. Anyone ever dealt with this sort of thing and knows what happens next? I want to be prepared. I’ve also contacted Companies House to suspend the company from striking off the register until this has been dealt with which they accepted.
    TIA

Is the amount over £600? Then get the sheriffs in (much better than baliffs)

If I am reading this right you are trying to get back £1200 from a motor trader. This thread is for flight delay compensation. If you find the proper post for your query I am sure you will get some expert advice.

I am claiming for the compensation that I should have been given from his delayed flight company. He was paid it back in 2018 and I never received it. He ignored my emails. I’m just worried that I’ll send the sheriffs and they’ll say there is nothing because there is a new business in the premises.

    Yes.
Sent a cheque that bounced then when I emailed copying the court in that I would look to pursue the proceedings unless I had money within 48 hours they BACs it within 30min

Have you submitted an MCOL? Nothing happened until I went legal then they tried "you'll lose" track but just waited it out
