KLM - EU threaten to take them to court 14th Aug 10 at 6:10 AM
Just heard on the news that because KLM have ignored the Dutch government and not paid compensation in full (they only paid 1 night) they have been warning by the EU that they will take them to court if they dont compensate in full.

the BBC picking up the story for us was a major success for our campaign, we could not have asked for more publicity yesterday the story rolled all day on the news channel and on all news programmes. it was really good of simon calder to help us get the story to the BBC and we hope that the fact that the EU made the statements they did will force KLM to change their stance. Only downside was that due to the EU spokesperson my interview didnt make the nationals and I wont be famous, ahhhhh but the story also hit local news and radio in my area and they showed my piece

Its been difficult over the past few months but the pressure to get the media to pick up the story I think was worth waiting for and now we wait for KLM to change their stance.

Having previously received the standard offer from KLM (ie 1 night, max EUR350 - whereas actual expenses were closer to EUR2000), and starting to initiate my own legal proceedings (not yet served) - yesterday I received a revised offer from KLM by e-mail - out of the blue.

They're now offering to pay "for all nights/expenses but subject to EUR1350 limit". Bit of an odd e-mail as all previous correspondence has been by letter. I realise this still falls short of their absolute obligations under EEC regs, but apparently a significant shift in position.

    Anybody else received similar ?

Looks like it might be worth asking again for reimbursement of accommodation costs - 8 nights totalling ~450 in my case.
I'll let you know how I get on.

Having carefully reconsidered your claim we are pleased to inform you that KLM is in a position to reimburse the whole 8 nights hotel accommodation and expenses.

In order to make a payment please provide us with the originals of your receipts,...
Those'll be the receipts that the travel insurance place says they posted back to me weeks ago but I haven't received.
All I've got are scans at the moment. I'll request copies from the hotels I stayed at. I'll be in Tokyo over the New Year period - maybe I could pick them up in person!

Asking KLM if scans would be OK will probably mean waiting several weeks for an answer but I'll do it anyway and in the meantime ask the hotels to send copies to me.

    They aren't accepting the scans...
Due to legal reason of exclusive right to refund we can only process refunds upon original receipts.

I've just been on the phone to Axa again. They claimed they had posted my original paperwork back to me by recorded delivery on 10th December. They say they'll get back to me with the tracking number in the next few days.
As far as I remember I originally requested return of the documents in August or September. They also said they were going to post them when I chased them in November and that they'd been posted on the 7th December the last time I called them.

The money is due to be sent to my account on the 11th Jan. I always knew I'd get there in the end.
It looks there may have been some benefit to the amount of time it's taken to resolve this as the amount to be paid is slightly more than expected - presumably due to the Yen/ exchange rate movement since April.

Hi Ahar, could you tell me the KLM contact details you used to get your claim settled.

    Thanks Jim

klm 2010 ash cloud still no compensation
Three of us had to stay in Rome for and extra six days due to the April 2010 ash cloud problems. Whilst we made the most of our extra time we were very disappointed with the lack of information from KLM at the time. Since then despite many letters, emails and phone calls to KLM and contacting the AUC we have had none of the 830 Euros (about 240/person for the six days) which we claimed.

Is it worth going to the small claims court? many thanks

In a word, Nelliek, yes. It's the only way they will listen to you. After all this time they will be convinced you are not serious.

You'll need to read up on the threads here, write a letter before action, then fork out the small claims court fee (you get it back if you "win")

I spent a year squabbling with a European airline and they refused to pay more than about half of my documented expenses. When they received the claim from the court, they paid the money into my account in about a week!

You just need to put in the effort to do the reading, then go ahead with the conviction that you are being both right and reasonable.

    Best of luck!!

I wrote to KLM using the online letter from Which for using the small claims court and it worked and we got full compensation. Thanks
