Hello all
I recently received a ccj claim, I filled in a defence online and a while later I received a questionaire about mediation, which I returned.
The next thing I receive a ccj in default form (dated 19th June), despite having competed a defence and sent in the mediation form. I assume the mediation form wasn’t logged court side.
Ok so I was planning to try to set aside as I have a great case against these people and am preparing it.
Today only 10 days after the judgment which states 28 days to pay, I have received an issue of warrant of control dated only 9 days after the judgement itself (so much for 28’days to pay) staying bailiffs will come on July 12th, still less than 28 days!
What’s the best course of action from here.

Hi,
Best to stick to just the one thread, so as not to cause confusion and have people repeating themselves.
What are your intentions now, do you intend to pay, or do you intend to file a setaside application ?
If the former, pay it and that will be the end of the matter, if the latter, get your setaside application sent in straight away, if said bailiffs do turn up on July 12th, the advice would depend on what the debt was for originally.

I was defending the claim, but somehow a default has registered despite forms going back on time.
My main concern is that it seems crazy to allow 28 days to pay, but a warrant be issued after only 9 days. Is this normal?0 -

Some companies are more keen than others.
It would help enormously if you could tell us :
(A) Who the creditor is.....?

Basically they allowed people to order goods from an ecommerce website of mine and processed the card payments without performing checks on the address of the card holder, id post the goods, with tracking, could prove receipt, customer would chargeback, and I!!!8217;d lose as the delivery address was not the billing address. So lose goods and money.
I challenged them and have evidence to take it to court, but someone my form hasn!!!8217;t been logged and they got a default judgment and are trying to bully their money after only 9 days since the judgement, despite me having 28 days.0 -
You don't have 28 days. The 30 days is a time you can pay a CCJ within and have the CCJ removed from your file as if it never happend but the CCJ is due immediately the order is passed and can be forwarded for enforcement straight away, there is no 28 days "leeway" as it were.0

You can apply to the court to suspend the warrant for the bailiff action by filling in form N245.
