    Sorry to disagree. S35 is about disclosure.

    A Data Controller may make a disclosure for the purposes of legal proceedings, they are not obliged to.

    It does not absolve the Data Controller of their responsibilities to ensure the information is accurate & up to date when they make the disclosure.

    I had this out with my lease car company in the good all days before POFA. Why did they hand over my information,

    How did they know who the driver was - they didn't
    Private Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA :D

    This was featured on today's Moneybox programme on Radio 4. They had somebody from CAG on there together with that guy from Cambridge who is trying to start a class action.

    The programme read out a statement from the association that represents debt collection companies which said that only a "very small proportion" of people get default CCJ's . They would say that, would't they?

    You can here this on the BBC iplayer. It's the first item on the programme.

    whats it got to do with them , the debt collection companies that are involved in the PPC scandal , cannot bring a court case , only the PPC or the PPCs colisitors

    following to Mrs May."



    "Dear Mrs May
    Firstly my belated congratulations on your achieving the position of
    Prime Minister.

    The real reason for this email is to draw your attention to the way
    that the Private parking Companies and their debt collecting associates
    are harranging people with their half truths in support of parking
    charges for alleged infringements some of which were committed several
    years ago prior to the POFA of 2012 when the prevailing advice
    (including that from a well known BBC programme) was to ignore them
    unless they could positively identify the driver and not the keeper.
    These companies who purport to be reputable legal companies are trying
    to use the assumed ignorance of the law to get people to pay the
    ridiculous charges that they are demanding.
    There are several web sites which illustrate the extent of the problem
    but it is only the tip of the iceberg shown there. Most ordinary
    people will be paying up in the light of the threats being made. A lot
    of people cannot afford this level of cash from their meagre savings or
    income.
    I am at the moment trying to assist a Carer lady who attends to my
    wife. This lady's car was in a car park in 2011 long before the POFA.
    She is now being pestered for money by a company called bwlegal.
    These debt collectors know that at that time the driver of the vehicle
    could not be identified and could have been anyone of four or five
    people who unknowingly infringed.
    This persecution of ordinary people really has to stop. Neither the
    amazingly unfair verdict of the Supreme Court in the Parking Eye v
    Beavis case or the POFA have helped. All they have done is encouraged
    these concerns to greater efforts in extorting money from people.
    I came to you because I have tried contacting my MP and Oliver Heald
    but both show little interest. (I assume that you do want a
    conservative Victory in 2020?)"

    Got this in return

    "Sir Alan has been informed of your response and letter to the Prime
    Minister. However, until the results of the discussion paper are
    published he regrets he is not in a position to comment further on the
    contents of your email."

    So I went back;

    "In other words he is not even interested in passing a constituent's
    concern along to the dept headed by Sir Oliver Heald that deals with
    this kind of thing.
    Sadly just living up to the impression that most of the public has of
    MP's these days.
    Well he's had it for my vote next time around and probably a few of my
    friends when I tell them of this story."

    I'm not expecting big things but it makes me feel a biy better.
