Resigning as Executor

  • Thanks. A family member registered the death and had the bank account frozen so hopefully they sorted out the once only form. It goes to show that everyone should perhaps be a bit more aware when they appoint executors that it’s an absolute minefield and shouldn’t be taken lightly. Really appreciate your helpful comments.

And checked the private/occupational situation? Was the deceased a home owner /rent payer? Did he have any chattels? Merely safeguarding the assets does not appear to constitute intermeddling.
  • He literally had nothing. No property, no job and no money which was pretty much the norm for most of his adult life.

Can we categorically confirm something for you here - there is no way a deceased family debt can be ''inherited'' by other family members whether they are executors or not.
You and your sons do not have to pay one penny of his debts.
A simple letter to his debtors is all that is required.

If the claimants persist in contacting them perhaps by implying that the executors are responsible for the debts go to trading standards or the financial ombudsman.
