    I'm not trying to be greedy, but my travel group was just offered compensation this morning for a 12 hour delayed flight in 2011, but Easyjet declined to pay for the infant that was travelling. The infant payed a 'charge per infant (under 2 years)' but Easyjet said in their compensation offer:

    'Please note that infants are not entitled for any compensation unless they have booked a separate seat for them. This is inline to European law and our Carrier's regulation which you've accepted at the time of booking'

    I was under the impression that as long as you 'paid something for the infant traveling' that they were also entitled to compensation as they had to wait for 12 hours too, like everyone else? Can anyone offer some advice, or point me to a similar question on MSE that might offer me some help? Thanks so much for the help, as I'm just trying to figure out if Easyjet is following the law or if they are trying to save 400 euros for the infant? :A

  • Do you know of compensation being paid out for this situation in the past. Situation being that if any incident is not on your flight then airline is at fault and should pay out compensation .

    Please search within the same thread for a post on easyjet from me (and others).

    There are a number of steps you will follow to start with a claim for compensation, since from what you describe the airline obviously had to find a re-routing option but should also pay for a compensation because the flight you were supposed to take wasn't the one affected.

    The first 2 steps will be 1) to gather the facts (all arrival/departure times, delays, verbal advice etc written down), and get records from the flightstats website; 2) get written advice from the UK civil aviation airline.

    Then you will need to write (at least twice) to the airline stating everything in detail but clearly, they won't accept to pay anything.

    Unfortunately for them, from there it will be straightforward for you to sue them in the court. You can either do it by yourself or use the services from one of the specialised solicitor companies. You can also use their services to initiate the whole contact with the airline in fact, they usually also run a database of all flights and all cases they are dealing with.

  • I have a question regarding the definition of extraordinary circumstances.. I've read Vauban's guide and it seems like under The Wallentin-Hermann Judgment I should be able to claim compensation. I have been rejected compensation from easyjet already so seeking a second opinion before I take it further.

    My flight from Prague to Gatwick was cancelled and rescheduled for the next day a month ago, here is the email from easyjet explaining the delay:
    We are writing to say how sorry we are for the overnight delay to your flight. Regrettably due to earlier delays the crew allocated to your flight did not have enough working hours, within the legal limits that are set, to complete your flight as planned. This meant we needed to call on standby crew members to help out.

    Their response to my claim:
    We would like to say sorry for the delay to your flight. Regrettably this was caused by air traffic control restrictions affecting the schedule of your aircraft. Safety is our number one priority.
    In regards to your claim for compensation, we are regulated by EU Regulation 261/2004 and must work with this so that we can be fair to all passengers caught up in this disruption. This regulation details the conditions by which flight disruptions are classified, either extraordinary circumstances or non-extraordinary circumstances. Your flight was disrupted as a result of extraordinary circumstances, i.e. a situation out of easyJet's control.


    There was an air traffic control strike in Spain that day, however obviously my flight wasn't directly affected by it and it also wouldn't have flown anywhere near Spain. The issue seems to have been previous flights affected by this strike then affecting mine. The strike was announced a month in advance and if it's staffing issues that meant my flight couldn't fly then surely easyjet haven't taken all reasonable measures to prevent a delay to my flight specifically in this case. What do you guys think about this use of extraordinary circumstances and if I have a case?

    Clearly they have changed their "excuse" to one of a potential EC.
    As you have in wriing/email the original reason, you have a valid claim. Even the second excuse is still valid for a claim as it didn't affect your flight directly.
    Send an NBA then start preparing your N1 for court application or hand to a NWNF solicitors, Botts being an example. Have you checked the Bott website for your flight?

  • I experienced a delay on my return from Cyprus in Jun 15. Three weeks ago I telephoned EasyJet to ask for an address to which I should send a compensation claim. The helpful guy in Customer Services told me that he would deal with the claim there and then. I passed all the required information and was told that compensation would arrive in 2/3 weeks. It has arrived as promised and the whole experience has been without stress or confrontation. There is a lot of negative stuff here and probably for good reason. I have no wish to diminish the problems that others have and are experiencing but when the airline gets it right someone should say so. So, well done EasyJet and thank you from a satisfied customer.
    For all the cynics out there, I am a retired RAF engineer and do not have any loyalty to or connection with EasyJet

Apart from having to sit around an airport for nearly seven hours with two young children, we didn't suffer any other expense. Easyjet provided a voucher for a snack and drink, which turned out to mean a sandwich, so we got lunch. The reason was given as technical difficulties, and they emailed us to apologise.
    When we returned, we started a complaint through resolver. We waited two weeks and heard nothing, so we rang the customer services. A helpful lady took our booking reference and told us over the phone that we were entitled to compensation.
    My account was credited with £1167 on Tuesday, which seems very close to €1600. It took just under four weeks.
    So the moral is Easyjet will compensate, without threats.
