What is a Subject Access Request?
Have you tried Google? It does save us having to type out basic stuff time and time again that can be found so easily via Google.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • As mentioned before, I have sent an email to gladstones... but I have not yet received a reply. Based on your experience, does my emailing them constitute a "reply within 30 days".. or do they require me to do it online as per their letter?

Their Letter Before Claim is dated 27th September, meaning there is just 4 days left to "respond" if they do not read my email or count it as replying.

    Thanks

Your response does not have to be online, it can be email, letter, or hand delivered on a stone tablet.
  • So it's the day before the 30 day deadline and I have still not received a response from Gladstones... so I'm beginning to wonder whether the email address I used to contact them is in use?

Should I just use their online form? (found here: gladstonessolicitors DOT CO DOT UK /user )

(I obviously won't be giving my phone number, but I would like to make sure that they have my response)

    Thoughts?

    No.
    You used their email
Their fault if they dont monitor it

    Look, be realistic.
    They never follow the PAP
They never actually try to narrow the areas, as GS have NO documents.
They will ikely follow through with a claim at some point.

More important to get that SAR (all data, all photos) from the scumbags, so you can see their hand.

It may not make much difference, but notice the VP (Visitor Parking) on the bay we parked in.

Where do I go from here?

    Many thanks.

Wait patiently for a Claim Form to drop through your letter-box I would have thought.

Whilst waiting perhaps brush up on how to deal with it when it arrives by re- reading post #2 of the NEWBIES thread.

So the Claim Form arrived in the post today - and the "particulars of Claim" say:

The driver of the vehicle with registration XXXXXX (the 'Vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract') at ADDRESS, on XX/XX/2016, thus incurring the parking charge (the 'PCN'). The driver of the vehicle agreed to pay the PCN within 28 days of issue yet failed to do so. The Claimant claims the unpaid PCN from the Defendant as driver/keeper of the Vehicle. Despite demands being made, the Defendant has failed to settle their outstanding liability. THE CLAIMANT CLAIMS £100 for the PCN, £60.00 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £34.40 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.04 per day.

I never "agreed to pay the PCN" - this is straight up lies!
I have also already told them (before I found this forum) that I was not the one driving, it was my wife who was driving and to transfer the liability... however they simply responded that it was now with debt recovery plus.

I've also checked Google Street View and can see they have dropped the signs right down

https://i.postimg.cc/KvM6QKgV/1.png from 2016 and shows where sign used to be (high)
https://i.postimg.cc/3RqqF7rY/2.png 2018 showing the sign dropped down to eye level.

This tells me that they realised that the signs were too high and had them dropped due to losing cases in court? Or is that wishful thinking?

I would also like to add, that there still is no signage on entrance - https://goo.gl/maps/e63NXhWntez

What are my steps here... Shall I just follow the guide set here: https://forums.moneysavingexpert.com/showthread.php?t=5546325

And use something like this: https://forums.moneysavingexpert.com/showpost.php?p=74674865&postcount=24

    Thanks in advance

What is the Issue Date on your Claim Form?

Did it come from the County Court Business Centre in Northampton, or from somewhere else?
