Business Sold. Told Not Suitable to Continue Working.

Hi all. I'm posting on behalf of the Mrs here.

She works for a nationwide company, who have sold the location she works at to a local businessman. He has personally informed the staff that the majority of the current workforce will no longer be required once the change of ownership completes, as he has his own team from his other locations lined up to replace them.

He has openly admitted that he "only employs [people of a particular race] because they are harder workers". So obviously the workforce are up in arms.

The questions are: Is this legal? If this happens are we entitled to redundancy? If so, will it be from the old owners or the new one?

We just need some expertise to help fight what is a frustrating battle. Thanks in advance.

    Of course it isn't legal! But you really need to get proper legal advice - is anyone in a union? This may be TUPE, or not. It is certainly race discrimination, but can you prove it? Or do you have legal insurance on a household insurance or vehicle policy?

    You need proper advice, and you need it now, not later.

    To update, two months after they were informed by the new owner, head office have finally come in to tell the workforce that the place has been sold and everyone has been served with a one month redundancy notice today. Everyone is in the process of searching for new jobs, and obviously everyone is fuming about the new guy's racist attitude. Is there anything that can be done, or is it just a case of standard legal redundancy regardless of the reason?

    Quite possily an unfair dismissal and breach of TUPE regulations. Seek proper advice.

    Have you and the rest of the work force considered starting up your own company or know someone prepared to set up a company to compete with the new owner. You have the knowledge and time to collect information to give you a big advantage.
