Well a quick Google of XS Direct shows this kind of thing happens all time with their customers!

They appear too add a slew of other charges too. One was £3,942.28 for solicitors, and that's was on top of the £3,000 excess!
If they can legally add those then it easy to see how they could get to 12k.

I think you need proper legal advice rather than asking on a shopping forum. Your policy doc needs going through with a expert..

Xs direct are the worst insurance comapany EVER. Do not get insurance with this company as you will regret it a soon as any claim is made against you. They will settle the smallest claim even if wasn't your fault and will be left with £3000 debt. They do not investigate any claim as most liability you will have to pay to the third party

To anybody reading this...take my advice from someone who has past dealings with this company and pay a bit extra for a better supplier of car insurance. Just because there cheap doesn't mean there good.

Why would you be liable for the £3,000 excess you agreed to if it was a small claim, would you not be liable for the first £3,000 only if the claim was larger than that?

XS Direct have an ALL SECTIONS excess, it means unlike any other Insurer, you pay an excess of £3000 even if the only claim on the policy if from the third party.

A normal policy only requires you to pay the excess if you are claiming for damage to your OWN vehicle

I understand that but there was comment that it was "smallest claim"
If a claim was for a total of £1,000 I would have assumed that you would not be charged the £3,000 excess but the £1,000 instead

I can barely express what I think about this company and how bad they are. They operate under authorized theft by finding a loophole in the law that enables them to charge thousands of pounds in excess to their clients, resulting from any claims. Usually you do not have to pay the excess unless you have had work done to your own vehicle. But they have found a way around this. Google them, you will soon find out how they operate. The misery and stress they are causing to many people, often young people, forcing them into horrendous debt, and I am talking thousands of pounds, is absolutely immoral. And this on top of already high premiums. They deserve a massive come-uppance for the evil way in which they run their business. Just evil, that's all I can say. To see the anguish, desperation and stress caused by what they do is worrying. They may well be responsible for people going into severe depression and worse. I have witnessed this in my own family. Maybe we should make our complaints to someone like Martin Lewis - perhaps then someone will take the issue up with the authorities governing such corrupt companies. Avoid, Avoid, Avoid. ........Note: What I have also realised that INSURE YOUR MOTOR are complicit in the bad business practices of XS DIRECT, and knowingly assist them. Please don't be caught out.
IF USING A BROKER, CHECK WHO THEY ARE INSURING YOU WITH AND ESPECIALLY REGARDING THE EXCESS SCAM THEY ARE PULLING.

Where is the scam if the excess is clearly signposted when a policy is purchased?

Why would anyone in their right mind buy a policy with a £3k excess if they could not afford to pay it in the event of a claim?

The scam would be if the excess was not declared when buying a policy - in which case the FOS would uphold any complaints from customers.

Far too often people cry 'scam' when the problem is caused by the stupidity of the purchaser for not reading what they are buying.

Genuine scams should definitely be highlighted and tackled but being too lazy to read what you are buying does not make it a scam...

Another problem that can occur is XS Direct is usually taken out through an insurance broker, some insurance brokers really don't emphasise what the "all sections excess" actually is and when I listened back to my phone call I couldn't believe how he just "flowed" straight through that bit like it was nothing saying "carries an all sections excess and breakdown cover etc etc"

My situation is I'm classed as "high risk" due to having a car stolen, at the same time I also had to make another claim as my other car keys where taken and I was also involved in a fraudulent claim which the third party dropped the court case with no explanation and because the insurance company couldn't recoup the costs for getting the fraud team involved it actually went down as a fault claim.. no surprise I'm also facing £3000 all sections excesses.

my advice for others who are in the same boat as me is to look at specialists insurance brokers dealing with high claims, I was offered a premium which also had a seporate "excess protection" covering the entire £3000 should a fault claim ever arise. It's a lifeline to getting your no claims back and get rid of the ridiculous excesses.
