    Hi All,

    We're in the process of buying a new home and our solicitor has advised there is a possibility we would be eligible for SDLT Multiple Dwelling Relief as the property has a separate annex (completely separate to the building, own entrance, bathroom, living space).

    The uncertainty arises because it doesn't currently have a kitchen, but we will be installing one as soon as we move in as my mother will be moving into the annex. Based on reviewing the guidance for SDLT MDR, it does state that:

    'The relief includes provision for “off-plan” purchases where construction or adaptation of the property for residential use may not have commenced by the effective date of the transaction.'

    As we will be putting in a kitchen, we wondered if our plan to adapt the annex to include a kitchen will ensure we comply with MDR guidance.

    We are going to look into some specialist advice in this area as seems like a minefield and my Solicitor isn't able to offer much help as isn't his area of expertise, but any advice in the meantime from anyone who has been in a similar position would be really helpful.

    The “off plan” provisions are unlikely to help you, they are designed for cases where someone contracts with a developer for a house to be built and for some reason (like 90% or more of the price being paid early) there is an early “substantial performance” of the contract before construction of the dwelling has started.
