Argos refused refund despite having receipt and item.

Options
Ok, so i bought a present for my Nephew from Argos last week, got it home all looks good. set it in the pile of prezzies but as it's from santa ;) i removed the blatant Argos catalogue number.

Now when i have gone to return it. despite having the receipt for the item (and the credit card which purchased it) and the item in new and unopened condition, they have refused to refund me, saying "it could be from anywhere".

I tried explaining but they were having none of it.

Is this legal?

(Sorry if this isn't the right section for this post)

Forgot to point out the reason for return.
It is a duplicate item (already purchased by another family member)

Only one of those can possibly be true.

However it is a bit tight. But they have no obligation to refund after you have altered the item.

    It is obvious!

The item is either in the original condition with the argos catalogue sticker there, or it is not in the original condition.

Did that help? I removed the superflous bit about being unopened.

So by removing the easy peel label leaving no residue or marks, that means it's used?

    Ok, thanks for your help.

(oh and BTW i didn't mention original condition) i said "new and unopened")
