Council tax arrears in bankruptcy

Hi,

Just a quick question, HMRC are petitioning for my bankruptcy at the end of this month and I am not contesting this. Myself and my partner have £3000 of council tax arrears which I am aware will fall to him in the event of my bankruptcy, but he is a stay at home dad with no personal income. What will happen to the arrears? I have searched for the answer for hours but cannot find it anywhere so I m hoping someone on here can help?

Thanks in advance.

It's up to the council how they pursue this. Bailiffs are the most likely route.

He could maybe look at a DRO if he meets the criteria

I would suggest, if it's in England and Wales, he also looks in to applying for a section 13a(1)(c) discretionary relief.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Can bailiff ask me to see my bank statement and do I have to provide it to them? Please help

They can but you don't have to show them. Bear in mind that they also don't have to accept any payment arrangement.
