  • I have just been informed I am successful for an old Egg credit card PPI Refund however, it has been sent to my insolvency practitioner even though my IVA failed nearly a year ago as it is an asset. My IVA failed as I have been on long term sick with back disc condition, chronic pain and depression and had to resign from my job, my creditors refused to give me a 6 month payment break and I have since agreed payment plan with my creditors and one wrote the debt off. However, I have been on ESA which the DWP stopped in March statting I am 'fine' and ignoring my GP and Specialist, MRI results so I am going to tribunal again which I did 7 years ago with my lower back and won previoulsy, however this does not help my financial situation as no income, live alone, have just signed on JSA even though cannot sustain work, my landlady has also sold the property so I have to move by 1st July and am in arrears with my rent and utilities which I have told the IP regarding my PPI refund and they said as I claimed myself they will let me have 10% which will be £100-150. I have contested this when priority debts of rent, utilities and council tax should be taken into consideration against non priority debts of creditors especially when one creditor wrote the debt off. IP have not asked for any evidence of my landlady giving notice, arrears, bills arrears or bank statements, DWP letters evidence of ESA stopped. Surely my rent and living costs are priority, I get that I have no assets and this is seen as an asset despite the Egg card not being part of the IVA agreement either. Advice please?

    This is the correct process, your PPI refund is pre-IVA asset and is correctly given to the IP to distribute to the people who you borrowed from and did not pay back. You should be happy you got some money at all. It is logical that you should not gain extra money back from money you did not pay in the first place
  • I understand that however I am paying my debts back, I have arranged a payment plan with my creditors outside of the IVA. Priority debts vs non priority debts however is my query when am about to be made homeless and unable to rent anywhere else with no funds or clear my current rent and utility arrears, as all this does is force me into further debt.

    Hi Dunstonh,

    Just a quick one to say I have finally been successful with my claim against Santander (previously Abbey National) and have been offered £1,950 for my claim of 20 year ago. Although there was a bit of tooing and frowning, in relation to them saying they couldn't locate my accounts even after a lot of copy documents being provided. In a last ditch attempt to get my account numbers as they did not show up on my bank account statements, I wrote to my bank (Natwest) who provided me with a very helpful letter which I sent on to Santander, after which I received my offer. Definitely go through this process on your own, don't use a company that take a percentage if successful. Am so pleased I preserved.

    It doesn't force you further into debt as the money was never yours in the first place so if you were planning on spending it before checking these things out, that's a dangerous game. Rules are rules

    I made a claim against EGG with whom I had a credit card sometime between 2000 and 2010. I had no details or paperwork but they nevertheless responded positively and I was awarded £52.00 (not a great deal compared to some of the amounts awarded on this forum but nevertheless better than nothing).

    I've made a claim against NEXT with whom I am still a customer; they admitted that I'd paid just over £120.00 in PPI. They sent me the Letter of Authority but then said that I hadn't returned it (which I had, along with a cover letter) and threatened to close the case. I returned the second Letter of Authority along with a cover letter of complaint and have now received an apology stating that they are looking into the matter and that if I am not satisfied I can refer the matter to the FO. It seems extraordinary to me that they can admit that I paid PPI but to then drag the case out.

    I made a claim against M&S with whom I had a credit card but who advised me that I never had PPI even though I'm sure that I did (it's interesting how someone else on the forum was successful in their claim against M&S and who had a credit card within the same time frame - and when M&S were pushing their customers in store to take out a card with them).

    I have just submitted a claim to GUS (Grattan and Look Again) and have yet to work through the bank and the mortgage companies.

    It's not really that interesting. Different customers, different sales people, different circumstances.

    Not everyone took PPI and not everyone who did was mis sold.

    Your logic is very flawed there. Why should you get a refund of PPI which the Bank's records show you never had simply because someone else had the insurance and was mis-sold it? Not everyone in a given time period was mis-sold PPI. Not everyone who had PPI was mis-sold it.

    Unless you can provide solid documentary evidence that your account had PPI, you have nowhere to go with this...

    It's not somehow wrong simply to have had insurance...:eek:
    You really need to understand that administrative errors can happen in any business and that there was no conspiracy to deprive you of your £120.

    The banks frequently refund many thousands of pounds to individual complainants. By comparison your redress is peanuts and such amounts will normally be refunded without any investigation.

    I had the same experience with Santander, I worked for the NHS at the time I was paying PPI, I was able to prove that I would have received sick pay and the length of time it would last and my eligibility. I suggest you find your contract of employment or contact the employer about employee benefits you would have been eligible for at that time.

    I did my claim through Resolver and included all the details in my initial claim. They acknowledged the claim almost immediately and I received a refund within eight weeks.

    I have also received one of these letters from Santander regarding Debenhams store card. I was also employed in the Public Sector at the time of taking this card out and have followed your lead in providing them with as much information as possible.
    On a more positive note, I also applied for Plevin on a Dorothy Perkins account and BHS which had been rejected some years ago.
    Within three weeks, had full payment for PPI on both accounts. Was very impressed by speed. Now just keeping my fingers crossed for Debenhams.
