Claiming tax back without a P60?

My son has a pension from his late father's company whihc uses his tax code and he has a part-time job which uses the BR rate. He has paid too much tax this year as the pension doesn't use up all of his 10% tax band.

Usually we take the 2 P60s to the tax office and claim any refund. However he has manged to lose the P60 from his part-time job and although he has now asked for a replacement it could take a while before it happens.

1. Will the tax office accept his month 12 payslip or must it be the P60?

2. Will a repayment eventually be made to him when the tax office get around to looking at how much tax he has paid? If so how long does this usually take?

    HMRC "may" accept his month 12 payslip but a replacement P60 would be better.

    If you don't have a P60 and they won't accept the payslip, you could be looking at a few months before they'll be able to check the wages/tax against what the employer has declared to HMRC. Whilst the employer has to send returns within 2 months of the year end, last year HMRC took many months to actually process them, and there is every chance the same will happen this year also.

    If you don't actually claim the refund at all, it may never be repaid. With the HMRC being so late to process the payroll returns, they will also be late to check through the details of each taxpayer. In the past (i.e. with NIC), they actuall decided not to be pro-active at all and waited for the employees to contact them - it's their way of catching up when they've got a big backlog.

    Your best bet is to get the replacement P60 or search the house to find the one that's lost. If you can't do either, try asking if they'll accept the payslip. An even quicker way would be to voluntarily complete a tax return - under self assessment, you self-declare your income, and a repayment would be triggered automatically - they don't actually want "proof" unless they launch an enquiry later. You can register and submit a tax return on the HMRC website, but it may take a few weeks to get your user id and password.

    We'll ask the local tax office and see what they say about the payslip.

    The P60 never made it home. He picked it up at work, laid it down in the bakery dept where he was working and it disappeared - nobody knows anything about it!

    As far as a duplicate P60 - Sainsbury's always have "A Duplicate P60 cannot be issued" on their P60s so I'm not sure how successful we may be.

    As you say a self assessment return might be an option.

    Companies cant issue copies, but they can issue another document with exactly the same details on which states 'This is not a P60'

    I lost mine when I worked for DWP and they told me they couldn't by law issue another P60 but i could have the information on the different form.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    This has now changed and companies are allowed to issue duplicate P60s. Someone posted the link to the hmrc site giving this info a while ago. I will see if I can find it.

    Thank you everyone. I will ask the local tax office if they will accept a payslip as this will be easier than getting a duplicate P60 from Sainsbury's - they never do what they say they are going to do!
