Alright guys
I am in need of some urgent advice if you don't mind please..
We are renting a property via a letting agency for 16 months now and have paid our £600 rent in full on time always.. However this month we have had a slight problem with paying the rent..
We accidently paid City Council twice, instead of once.. So now we can only pay £500 for this month and have done so..
We have emailed the letting agency and explained the situation and that we will be able to the pay the outstanding £100 on the next due date of rent....
However they have just threatened us and want it paid by this Monday or they will start Section 8 or Section 21 procedure.. They are not taking into consideration that this is our first time and that we have always paid in full before...

We understand that the rent is a priority but please kindly understand that this is first time we have not been able to pay the full rent and only missed a £100.. We have always paid in a full on time before... We are not one of these people that abuse that situation!!0 -
The obvious concern for the LL is that if you are struggling to find £100 (from any source). Then how long before you struggle again.0

We appreciate that, but is there there any way you can pay e.g. credit card, loan from someone?
The EA cannot issue an S8 unless you are 2 months late with rent.
They could issue an S21 though.Should've = Should HAVE (not 'of')

Nope!! An s8g10 may be validly served if only 1p is underpaid for only 1 day. And could be taken to court for hearing, and in theory result in eviction. But no judge I've ever heard of would evict for that.We appreciate that, but is there there any way you can pay e.g. credit card, loan from someone?

They could issue an S21 though.
The 2 months is for ground 8: Still simple options to defend against that as a tenant.0 -

It doesn't matter if it is the first time. It is your responsibility to pay the rent on time even if you have to borrow it. It isn't the landlord's fault that you made a mistake with your finances. Also why does this have to wait until next month? Are your finances so tight that making an extra payment on something else means that you have no savings at all? What are you going to do to pay the rent if you lose your job?0 -
I’d be selling stuff on ebay/heading down the pawn brokers asap. It’s a bit late now but paying the full amount a few days late and blaming some sort of mix up would have been preferable to broadcasting that you’re flat broke to your landlord.0
