  • Hi

We were to travel to Switzerland, but while on our way to the airport, received a text from EasyJet stating that the flight has been cancelled, due to Industrial Action in France.

We had a full trip booked and now the only way to get there is to pay another £500 per person through another airlines.

Should we book the more expensive tickets and then ask for a difference in ticket fares from EasyJet ? What would be the best course of action to proceed?

    Many Thanks

I assume you were flying from a UK airport straight to Switzerland. The only thing that would effect your flight would be Air Traffic control in France if that is the case wouldn't it affect all flights through French airspace? So how could you pay extra and get another flight. Have easy jet told you the exact problem?

Yes, that is indeed the exact reason stated. We were travelling from London Luton to Zurich on a direct flight. They have stated "French National Strike" as the reason for cancellation.

BA however are still offering flights as normal.
  • To update they have offered us a replacement flight on the 31st May, the date when we are scheduled to fly back ... :O

Well then you have no option than to pay extra to get to your destination and claim compensation and a refund from easyjet.

But I would be enquiring why EJ cannot fly by rerouting, since BA seem to be able to do so. The ATC strike was known about in advance, allowing EJ to reroute. They chose not to and just cancelled instead? It does seem bizarre the difference in capabilities of different airlines?

Your flight is under 1500km so you are therefore entitled to compensation of €250 per passenger under EU261/2004.

Easyjet are telling customers on their website that they are not entitled to claim for compensation under 261/2004 as a result of the industrial action...

Easyjet are correct - ATC delays/cancellations are one of the few ECs they can count on to avoid compensation.

Easyjet are taking the easy option by cancelling flights instead of re-routing them on the basis that they believe they won't be liable to compensate passengers. As ever, "you gets what you pays for".

However, on the official EC list, number 30 states "Where Air Traffic Control suspends or restricts operations into or out of a block of air-space through which the air carrier must travel in order to operate the flight."

As BA have shown, airlines can avoid France & fly over Netherlands & Germany to reach Switzerland from the UK. I'd certainly support the airline if the arrival time had to be pushed back to accommodate a new route, but cancelling & offering an alternative flight several days later is really not a viable solution.

I think I'd consider taking a punt considering other airlines (such as BA) are re-routing flights to avoid such disturbances & the departure / destination airports are not directly affected.

Surely one can demonstrate that French airspace is not a "must travel" area in order to reach Switzerland from the UK, it's been proven on the day by BA re-routing their flights?
