Highview parking - online appeal process question

Hi everyone

Background: First PCN received last month for alleged parking that happened 5 months ago. PPC is Highview Parking. ANPR / Postal PCN. Overstaying in car park. Pictures merely show two headlights of a car.

The keeper is about to submit an appeal online using the blue template text in the newbies sticky without any amends.

Previous threads suggest there were 2 drop down questions when appealing on fairerparking website, however there are now 3:

1. I was the driver and the PCN contains the correct information
2. I was not the driver
3. PCN contains incorrect information

The keeper knows not to select the first option. Should they select option 2 or 3?

Keeper was not the driver but doesn't want to get caught out by selecting the wrong option.

Deadline is today so sorry for coming to you so late in the day. Was hoping to only post in this forum once the PCN was cancelled to stay thank you to the people who put together the stickies.

Thanks in advance.

    Keeper was not the driver
Then safely choose #2. Or #3 which would also be fine.

Once number 2 was selected, the next page contains three further options under 'please indicate your grounds for appeal':

    1. someone else was driving (with my permission)
    2. someone was driving without my permission / vehicle was stolen
    3. other

Is it safest to go with option 3?

If you select option 1 then you are required to provide driver details.

If you select option 2 then you are required to insert theft details (police ref etc).

If you select option 3 then there is a box to insert free text.

The answer is clear - option 3.

Yes they are doing everything they can to extract driver details! The keeper feels inclined to not say whether they were the driver or not and go for option 3 (PCN contains incorrect information) which doesn't request any further drop downs/options, just a free text box for reasons for appeal.

    what is your view?

sorry for asking so many questions!

Yes I think we'll tell people to choose 'other' every time.

Highview almost always cancel once they see the forum is involved. I think they are being quite smart as they know to continue to pursue will see them tie up considerable resources with next to no chance of winning, and even if they won at POPLA, the likelihood of anyone paying them is virtually zero.

Quite smart thinking ......... for a PPC!

Well done you on getting the monkey off your back! :T
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
