Good evening,

The keeper received a PCN NTK (via post) from Euro Parking Services Ltd (an IPC member) for the reason, ‘Not parked correctly within the markings of the bay or space’. The driver does remember parking there (not obstructing any other vehicles or pedestrians) until another space came free, which is when the driver moved the car to an available space. The offence occurred for a total of 8 minutes, yet has resulted in a £100 fine.

The keeper would like to point out that the ‘contravention date’ was the 21/02/2019, but issue date is 12/03/2019 (letter received on 15/03/2019). This is past the 14-days which the keeper keeps reading is the time limit Euro Parking Services has, but no mention of POFA 2012.

The keeper had a read through the Newbies post. In the driver’s case, should they just use the appeal template via the company’s appeals process? Should they mention the 14-day limit?

    Yes, send the blue template appeal you have already found.

    Send it unchanged - no additions or alterations needed.

    Send it as the keeper.


    You also need to edit your post to remove clues to the driver's identity.

    Firstly, please can you edit your post so that it isn't clear who was driving? The PPCs do come and have a read, so you don't want to identify yourself.

    Appeal using the NEWBIES template - don't edit it, it's perfectly fine as it is. You've rightly noted that they are IPC, so there is no point in appealing to them.

    You might find it helpful to search the board to see how litigious Euro Parking Services are, and where they trip themselves up.

    If your appeal fails, expect the debt collection letters as standard (nothing to worry about - they can't do you any harm), but DO come back and see what the advice is when/if you get a letter before claim.

    Also, very importantly, if you move house in the next 6 years (the amount of time they have to bring a claim), send their Data Protection Officer a rectification notice with your new address. You don't want them sneaking through a default CCJ because they couldn't be bothered to check for your new address.

    If you can, take a screenshot of the submission, and the confirmation page. It might be handy to you at a later stage. Just in case they say "oops, never received it".

    Ive received a letter about a parking fine about last demand, this is the first letter ive had as the address to myself is incorrect. So the fine is about overstaying, however I stayed 39mins in a car park where they allow 45mins free. How can I deal with this, ive already send an appeal from the newbies thread.

    Following on from the above, the keeper appealed via Euro Parking Services’ website on 20th March 2019.

    The keeper got the following automated response:

    Thank you for submitting your appeal to Euro Parking Services. This e-mail acts as acknowledgement of your appeal.

    A response will be sent to you within 28 days from the date that the appeal was received.

    We will however endeavour to respond to your appeal within 14 days but this may not always be possible.

    If you have not received a response to your appeal after 28 days then please e-mail us to check the status of your appeal at info@europarkingservices.com.

    Please ensure that you check your junk mail in case the appeal response is diverted there. We recommend that you add our e-mail address info@europarkingservices.com to your safe senders list to ensure delivery
    .


    It has now been 28 days with no further responses (the keeper regularly checks their junk e-mail). Should the keeper follow this up as instructed in the automated response?

    Doesn't make any difference if you do or don't though, does it, with an IPC firm.
