I am currently in talks with tooth fairy as well in regards to a loan that i couldn't pay due to unforseen circumstances now it has been passed to a company called Philips Specialist Bailiff & Debt Recovery Agents. I had an agreement with toothfairy in regards to paying them money i was ment to contact them on Monday the 5th of July but when i called i always got an answer machine. What can i do about this company as it was only a £200 loan amount!

Try negotiating with Philips as they are now handling the debt. REMEMBER THIS though... until such time as a CCJ is issued against you (which you would definitely defend in a court of your choice armed with all the crap TF come up with) you are dealing with Philips the Debt Recovery Agents, NOT Philips the Specialist Bailiff. Ignore any threats to visit your house or to remove goods as they cannot do this without a court order.
Remember this: nothing worth doing is easy.

Hi , All just an update , I took all the helpful advice from Dizzle ( Thank you very much ) and eventually negotiated a repayment plan with Northern debt recovery of £50 per month but I was a bit peeved off with the way they were threatening me , adding all charges ect ect I decided to contact the OFT they replied stating they were unable to deal with it direct but have passed my complaint to Trading standards as they have found a number of things not right with the company , I dont know if I should really say anything on here though !!!!!!
I would suggest anyone having any problems with Northern Debt recovery if thats who they say they are !!!! to contact OFT and Trading standards.

I've currently emailed philips debt recovery agents several times but never recieved a reply, i then get through the door that i have to pay within 7 days or i'm gonna get a visit from them. I think this is crazy, as i live in Scotland and i believe that if anyone comes to your door they are trespassing if they say i have debt, i have also heard that its illegal to discuss your debt on your doorstep and if this happens this voids all debt. Anyone shed any light on this?

I really dont want to call philips.

    Thanks

They will NOT visit your house. This is a scare tactic.
If anyone from such a company turns up on your doorstep, tell them to Foxtrot Oscar and if they refuse, call the police.

As for the bit in your post that I have highlighted, I doubt this is true. Debt just doesn't get "voided" like that. But as I said, they won't visit anyway.

As I mentioned, if *I* were in this situation with this company I would WANT them to take me to court. Their horrendous charges and interest would be very difficult for them to explain in court.

CCCS are one of the best companies out there.

The BS spouted about CCCS cases being unsatisfactory to them and that most cases end up in court is total nonsense and just plain scare tactics.

If you've made them a reasonable offer through a company like CCCS and they refuse it, this will only strenghten your case if it ever went to court (unlikely).

Their main target is the student population who whilst intelligent, are not always the best with money, so they use these tactics to get as many to pay up through fear rather than legal enforcement.

Stick to your guns and don't fret.

Oh, and if you ever end up in court for any debt, it doesn't mean the bailiffs will be sent automatically. The judge tells you what you have to pay (if you lose) and you tell them how you intend to pay that amount and so long as you stick to it you'll be fine. Bailiffs only ever visit if you do not keep to the arrangement you agree to when the judgement is made.

    Dizzle,

Although I have no dealings with TF, I have several other Financial Issues and would also like to thank you for taking the time to be so thorough in offering your advice and template letters.

I have saved these onto my PC for future use and just thought that you deserved to be thanked for taking such care and time to help people in such unfortunate situations.

    Well done you!!:T:T:T

Not true I'm afraid. The law is much clearer in England regarding this; however no matter where you live, you don't have to answer the door.
i have also heard that its illegal to discuss your debt on your doorstep and if this happens this voids all debt. Anyone shed any light on this?

Also not true. However, it's extremely unlikely that anyone will turn up on your doorstep. You also don't have to talk to them.
Please note that any posts that I make on here are based on my personal opinion, experience and what I have read.

    Hi all,

I have just entered in to a DMP with CCCS and have informaed tooth fairy finance of this, within SECONDS I had an email reply from them stating that they do not have to accept my DMP and payment in full needs to be made within 6 weeks......

...... Now do tooth fairy scare me? NO, nor do northan debt recovery or anyone else they pretend to be, I will say the same when they contact me. Being in a DMP and passing CCCS their details show I am not shying away from paying what I borrowed from them and whatever mad interest they add to this. They can send whoevver they like to my door. It will make no difference. However, I would like to know if anyone else has added tooth fairy to their DMP and if they have accepted it. Only as I want to know where I will stand with them. I am sure if they go as far as taking me to court and the judge see's that I have entered into a DMP and have spoken to tooth fairy expalining this that he/she will throw it out....

No matter what anyone tells me over the phone/ in an email/ on my door step means !!!!!! all to me. They can not have what I do not have. Yes I am silly for taking these loans out and I know that I only have myself to blame. We all have an excuse/reason for doing this but I have 10 creditors and if 9 of them agree to the DMP payments why should tooth fairy finance be any different.

Any advice for dealing with these pirates will help MASSIVLY!!

    Thanks
    Pipps

The only thing wrong i can see with the letters being sent is the opening line,

"thankyou for your most recent communication" this is too woolly, I would tighten it up and change the sentence to read "thank for your most recent communication dated xx/xx/xxxx".

Keep it very very very tight.
