Forgot to change council tax adress!! Huge panick right now 24th May 19 at 6:32 PM
I lived in the Royal Borough of Kensington and Chelsea from October 2018 till April 2019, then 2 months from now changed Borough and living in City of Wesminster council and been paying tax there .

Today I recieve a mail from the Borough of Kensington saying I owe them 900 pounds and that I have been summoned to court !!

I am 24 year old and arrive in the UK 8 months ago and Had no idea I had to 'sign out' from my previous council tax.

If I call them up on Monday and explain them the situation do you think they are going to remove this debt and sign me out from my previous council tax ?

    Im really stressed from this.

    Thanks

    Your post isn't very clear.

Did you tell RBKC that you moved into their area in October 2018?

Did you pay Council Tax from October 2018 to the end of March 2019?

You cannot possibly owe 900 for two months. But if you have not paid, and not told them you have moved out, they may now be demanding the charge for the full year if they think you have missed two payments.

Assuming you do not own the property you lived in in RBKC, then your liability ended when you moved out. They cannot take you to Court if you are not liable. But you need to let them know the situation!

Call them on Tuesday and tell them exactly when you left and where you are living now.

If you should be paying Council Tax at your new address, then tell you new Council as well.

If you left RBKC before 1 April, and had paid all the charge for 2018/19, then they will owe you money. If you left after 1 April, you will owe them a small amount.

Yes I've told RBKC I moved in October 2018 and have set up a direct debit with them - so yes I payed council tax From October to March each month.

I did not own the property in RBKC I was a tenant.

My tenancy start date for my new studio in City of Westminster was on 25 March and I already set up council tax with COW and already paid a month to COW council tax.

The problem I think is that I didn't tell them that I am moving OUT of RBKC, I thought it will adjust automatically when signing in with COW council tax.

So today I recieve this from RBKC: 'We have recently sent you a summons in the post for non or late payment of council tax. When a summons is issued the full annual balance, including 85.00 costs, becomes payable. Please pay 878.70 to clear your account before the court date on 20 June 2019. If you have already contacted us after receipt of your paper summons you no do not need to contact again.'

If you say I am not liable for payments since I moved out it's great, I hope they will say the same. It is a honest mistake and hope they will be understanding!

Then you owe them nothing. In fact they owe you a small amount. If the place you moved out from is still empty then the owner is liable. If there is a new tenant, then the new tenant is liable.

Stop worrying and have a good weekend!

Did your tenancy in RBKC end in April or did you move out before the end of the tenancy. If you moved out before the end of the tenancy ends, the responsibility for CT is still yours until your tenancy ends or a new occupier moves in, unless you and your landlord agreed to you surrendering your tenancy.

I no longer work in Council Tax Recovery but instead work as a self employed Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
