Cancel Council Tax but no new address yet

Hi,

I'm selling my flat but am not buying a new place straight away. I may spend some weeks back in Ireland and stay with family or stay with friends in the UK post sale. It seems that in order cancel my council tax, I have to provide the address I'm moving to. This is what it says on the form for the borough I'm living in in London. Without providing this, will I still be able to cancel the council tax?

    Don't think you necessarily need to (I mean, they can't charge you for the period after you cease to be responsible for the council tax) but I can see it being less plausible if you just disappear - why can't you give them a forwarding address of some sort?

    Legally you don't need to provide a forwarding address but it makes it awkward as they need to issue a closing demand notice.



    Calculation of council tax liability is based solely on the property and your legal association with it.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Why are you hesitant to give them your new address? Just provide it and be done with it. They mostly need it for the closing statement and to get in touch if there is something due back after the reconciliation.

    Just confirm the date of the sale and purchase of the new property - the council will charge you accordingly. It doesnt matter if say you buy the new property on 1st November and you choose to stay with friends until 21st November - you are still liable for the council tax.

    I've just done this - I ended up phoning them up so they could deal with it. I was paying month by month so no DD to cancel - and they pay any overpayment back into the account of my debit card I was using to pay by telephone each month.
