  • Does anyone know if the chargeback can apply to PIP implants? My wife had them 5 years ago (paid by debit card), but had them replaced last week when they were both found to have ruptured. As we are finding out the 'goods' are defective only now, could we claim back from the bank if we make the claim within 120 days? There was no way of knowing, or reason to suspect they were defective, until the story was made public.

    Sadly, my bank is Santander, so anything we try to pursue will be a long hard slog, but if there is a chance of success, we will go for it.

    I would put in a claim via my bank.

    Also I would speak to the no-win no-fee solicitors. They may be able to make a claim for injury and that will result in £1Ks worth of compensation.

    I bought an item on ebay and used paypal to pay the £615.
    The seller sent to the wrong address so I claimed a refund under didn't recieve my item and to my horrer they refused to uphold my claim saying they had a valid tracking even tho it wasn't to my address??
    I've now used chargeback to reclaim this and now waiting the outcome.
    Thanks for the info on this as when I first went into my bank they said I'd no recourse as it was a debit card!!

    I beleive so as the form the bank sent wanted details of the return. Best to speak to the bank though if for whatever reason you cant return the goods.

  • Well barclays wrote back asking OH to confirm the dispute for damaged/defective goods and to send them the paperwork along with proof of return :mad:. 1) I sent everything in with the letter and 2) we never got the darn goods!

    Rang up and they repeated the news that it is a loop hoop, They cant chargeback because the goods got to the UK and were intervepted by a third party. I have complained on the grounds that the goods must have been defective for them to get seized at customs and we would have returned the club if received. New complaint logged and dispute team updated.

    Goona be a fight but Im still go try. It will cost Barclays £500 if I go to the ombudsman so its in their interests to come to an agreement.

    PS dont for get that supergolfstore.co.uk is a sham and not a UK website. The goods are fake.


    Surprising update

    Bank still didnt want to play ball and I was too busy to get around to sending a complaint letter but just in case we asked for a refund from the supplier and it was processed!!?? Lost out a bit on exhange rate but a nice surprise given that as far as we can see it was a con becuase the goods were fake.

    I'm in the same position you was, a GStar website that looked genuine and had a UK address but was from China and wrong goods were sent and were fake!
    Company asked for the fake goods to be sent back, to China! I did this and they stopped replying to my e-mails!
    Put away a chargeback request to the bank, as my son is only 16 and it was him that made the purchase, with a print off of all the e-mails. Now the bank wants us tosend a proof of delivery for the return and an invoice, which the company never gave my son!
    Feel a bit stuck now, what should I do next?
    Where would I find a copy of the next letter after the first chargeback request letter?

  • Sorry to hear that BB66 I think trading standards should have more power to stop these sites or at someone should make them have to declare where the goods are from :mad:.

    If the bank has replied then it should mention something about appealing. If not ring up and ask them to make a complaint and they should take this over the phone or send another form out. Follow their complaints process and if no luck contact the ombudsman.

    Banks dont like that as its costs them £500 regardless. We never got the goods so no proof of return but your emails should be enough.

  • My wife and I ordered a greenhouse over the phone, after haggling a really good price (we thought at the time).

    We paid in full £1560, using a VISA Debit Card.

    A month later it has not arrived so we tried to contact the company(s) and discovered they have gone into administration.

    We tried a Section 75 claim with the bank (Barclays), response was Debit Card not covered under that. They didn't tell us about chargeback though which we found out about here! :T

    Have downloaded and filled in the letter template and will let you know how we get on.
  • I was due to go to pontins on the 27th August after getting married on the 25th.my dad passed away during the early hours of the 26th. We contacted pontins straight away and told them we wouldn't be coming. We had paid half board, for gas/electric and bedding none of it we used. They won't refund or give us a more suitable date. Im wondering if we'd be covered by chargeback as we paid with our natwest visa debit. Any help will be greatly received
