    Strictly speaking the council don't have a discretion over issuing a reminder notice, for example, reg23 of the Admin and Enforcement regs states "...the billing authority shall serve a notice reminder notice on the liable person stating..." whereas for issuing a summons under reg34 "the billing authority may"

    All this being said, in real terms the council are the people managing the system so if they choose not to issue a reminder notice or apply for a summons then there's not a lot that can be done. Providing the council don't exceed their statutory powers they are generally regarded as working reasonably.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Thank you all.

    Eventually after a couple of calls today the fees are waivered, paid up to now and set up a DD though house should be sold next month anyway.
