So they say they offer Car Park Solutions...
Anyway, the owner of my vehicle has been given a PCN of £70 (or £40 if paid by 03/05/18) at a local Aldi store.
I'm going to use the template from here, as seems quite similar. The vehicle was in the car park for 104 minutes on a 90 minute stay. Should I mention lots about the grace period, there is a lot of work going on in the car park (resurfacing) resulting in a lot of cars and very few spaces and having to wait for a spot...and that exiting is not easy due to the way the traffic flows due to the recently renovated McDonalds?
I've read some posts on here and think what the other posted has drafted is pretty good. Any further advice would be appreciated.
I'll try speak to the Aldi store manager this week and get the appeal in ASAP.
Thanks

its not the owner they wrote to, its the keepers details they got from the DVLA , that is the person they wrote to
yes use the template (from the NEWBIES sticky thread) to appeal as keeper on their website
and the keeper could add a paragraph stating that grace periods detailed in the BPA CoP cover any ALLEGED OVERSTAY , also add a copy of proof of patronage (if available)
as a side issue, COMPLAIN TO ALDI CEO AND INSIST THEY CANCEL IT, this is the best option , but appeal it with PE within the 28 day window if its not cancelled by aldi0 -
Was the PCN received by day 15, and does it have the POFA day 29 paragraph on the back?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.
Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas. You never know how far you can go until you go too far.0 -
I'm going to use the template from here...
Not sure that paragraph about the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 has any relevance in the context mentioned.
Why don't you sent the template from post #1 of the NEWBIES FAQ sticky thread?0 -

Keeper noted.
There's proof that a purchase was made at the store by the keeper. And the day before. And the day after. And the week after.Coupon-mad wrote: »Was the PCN received by day 15, and does it have the POFA day 29 paragraph on the back?
Yes, within 5 days and statement on the back.I don't think I would be using that post as a template.

Will do.
I'll get in touch with the store manager, then the CEO, then get the appeal in.0 -
Been a busy week.
Popped in store and the person I spoke to said that if I brought a receipt in and a proof of payment, they'd sort it.
Went in this week and spoke to a different assistant manager and she said the same...but nearly didn't appeal it for me as I'd only spent less than what she'd warrant for a 90 minute stay.
But, she said she'd cancel which is great. Said not to contact PE and that they'd do everything for me though. Should get a reminder through, then a notification of cancellation.0 -
She is wrong - they are litigious, so we say email PE to check it is cancelled:

Also, she admitted to a hidden clause, not visible to the consumer, about when the charge would be cancelled due to a spend. that is the definition of an unfair contract!0
