Voided car insurance please help

Hi,

I got a custodial sentence of 40 months in 2009 which was not for a driving offense, My sentence expired in 2013 i then took out car insurance which asked if i had any unspent convictions which i replied no as my conviction was spent,

around a year and a half later my insurance contacted me and said I had not disclosed the correct information they asked if i had been in prison i said yes told them the truth they then went and looked into my previous insurance searches to see if i was just trying to fraud them which i wasn't,

They came back with they were voiding my policy but giving me back all my premium for the full time i was a customer as it was an INNOCENT NON-DISCLOSURE. Do i need to declare this as i am now struggling to get car, bike, house insurance or is there anyway to get this removed from my record???

PLEASE ANY ADVICE WOULD BE GREATLY APPRECIATED

    Your conviction wasn't spent though so you did not answer the question accurately. Did you do any searching to find out what 'spent' actually meant.

  • It means they believed you when you said you thought it was spent.

    But, fact of the matter is you have an unspent conviction (40 month custodial sentence is only spent after 7 years as per this guide: https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/299916/rehabilitation-of-offenders-guidance.pdf)

    You need to declare this sentance until it is spent.

    You also need to now declare the voidance.

    Although it means they don't intend to take the issue further (is no fraud proceedings against you) you must disclose this voidance to other insurers.

    Otherwise the same thing will happen (this will be recorded on a shared database), though it wouldn't be considered innocent non disclosure.

    As online off the peg insurers generally won't quote with this in your history you could try a local broker (not Swinton) to see if they can get cover for you

    Innocent or not it is non-disclosure as your conviction wasn't spent. Unfortunately it cannot be removed and you will need a broker probably to source a specialist who will take on a risk where you have had a voided policy. Be prepared for a hike in premium too.
