Old CC debts, interest added.

I had a pretty bleak period in my life between 2011-2013 where I tried to live in London and failed miserably and just ended up in a lot of debt.

I had a barclays overdraft of £2000, I had credit cards from vanquis, aqua, barclaycard and I also had multiple payday loans from wonga and paydayuk. I moved away and just buried my head in the sand, opened a basic bank account with natwest and tried to forget all the debts.

In the past 2 years I've been trying to sort out my old debts after learning I have 3 CCJ's on my credit file. I make payments to all three of the old credit card debts through the companies they have been sold onto, however after checking the debts on my noddle report I can see that after I stopped paying them initially and moved away A LOT of interest/charges were added. for example-

Vanquis balance at time of default (29/12/11) was 373, by 2016 it was at 552, when I started paying it off at £5 a month. My question is, can I question these charges?

Basically all the accounts are like this, and its gutting because even though I've been paying them for a few years I'm basically only just back at the balance I left them at before burying my head in the sand.

I'm currently going through the process of trying to claim back the unfair interest on my payday loans so thats looking hopeful apart from wonga. Just wondered if theres a similar process for the interest added to defaulted credit cards?

    Once legal action has been taken it means a court has ruled you owe the money and that is pretty much that, if the interest was added before judgement, the time to complain would of been prior to legal action been taken.


    There are exception`s to this, you can apply to set the judgement aside, but you need good reason, either you don`t owe the money, or had another good reason why judgement should not of been granted.

    I would check to see if the Judgment Creditors for each of the three CCJs are entitled to claim post-judgment interest (if that's what you mean has been happening). If not then you can challenge it.

    Even if they are entitled to claim post judgment interest a Time Order can put a stop to that, but a lot would depend on the amount of the CCJ because there would be court fees involved.

    As for the other old debts (that don't have CCJs unless I've misunderstood your first post) which you have been paying to various debt purchasers, then I would suggest you send a s 77-79 CCA Request in the first instance to each one to see if they are enforceable in court.

    Once you know that (whether they are enforceable) you can consider your next steps.
