    I don't think the left hand knows what the right hand is doing, parking management contracted out to a contractor that contracts it out to another contractor, (surely Care Parking can't do court on that basis anyway) also no mention of progressing to court in the contract, but a statement that:


    "This may include issuing penalty charge notices"

    care seem to take on locations where court will not happen , ie rail stations , they have recently replaced parking eye at aldi (preston) another no court case location

    Would it make sense to Ring popla and change category?
    Will it need to go to court instead if it is rejected?
    Whole minefield.
    Definitely saw the PDF reference but no idea how missed the category definition in newbie thread.

    I did not know how to word it appropriately to make a valid point (yes I hear the collective group scream!), I do get lost at times in the language although I know everyone is going to great lengths to help me. I find it hard to understand some of the relevant points and without asking someone to write it for me (which is not right of course!!) I thought there were other relevant points already included.

    Additionally I thought that I got conflicting info about the 28 day deadline so did not want to risk it....

    I also thought some people were frustrated with me so did not want to mither more than I already was!

    Anyhow it is done now and we will see. Ongoing advice and guidance is gratefully received as I might have to go to the next level of appeal?

    Believe me you would know if people were frustrated with you, I haven't seen anyone like that on here.......yet :D


    You are at the end I don't know how many appeal stages you think there are or where a third stage is listed certainly not here!


    The regulars would have gone through your POPLA appeal for you before you sent it, but what's done is done.


    You should get their POPLA evidence to rebuke though so ask for help if you get that.


    Keep in the back of your mind that the idea of this appeal is to kill it so you stop the hassle, but also that Care Parking have never done court to date, and if this is not relevant land they can't, so stop worrying!

    You could have written: 'the land is under statutory control of TFGM and so there can be no keeper liability. This is not relevant land'.

    You might get away with sneaking that in at comments stage, because of the PPC cough up a landowner authority contract, it will be from TFGM.
