moonlight tenant gone!

I need some guidance re a moonlighting tenant. I'm the landlord, I don't want to put detail on an open forum, can someone experienced in the legal situation of this please pm me?

    * definition of 'moonlighting'

    Just post on the forums as normal like other landlords do with No personal details or addresses, what's special about you !
    Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....

    Well. This is a change from the usual posts here which are LLs trying to get tenants out, so look on the bright side..

    Legally they probably owe you money, and my only advice would be not to throw good money after bad by pursuing them too far.

    In the meantime start by changing the locks and collecting their post.:D

    PS and listen to GM, he knows what he's talking about.

    Yeah good point, I think GM's questions have referred to that: definition and evidence.. But changing locks is just basic security, if you don't know who has them. The new keys can still be supplied to the tenant if necessary, and the action explained as in their interests. Collecting their post similarly. I don't think many people appear to do a moonlight just to land their LL in the s***.

    Yes, in Scotland. Police have confirmed once they've checked on it that it's been emptied. No notice provided - should have been 2 months. in a fixed term rental agreement previously.

    do I need to persue possession order? Police said tenant has broken tenancy. Can I change the locks now?

    If you want to share experiences with the questions and replies for the benefit of the community then post away.

    If you want private bespoke advice then suggest you pay for such by going to the many places it's available, landlord associations, housing solicitors, legal websites etc.

    Here we're just a community and IIRC it's against forum rules to canvass for paid work via private messages.

    I can't comment on Scotttish Law.

    In England, changing the locks before a tenancy has ended risks a criminal charge of illegal eviction.

    Only a tenant or a court can end a tenancy. The tenant appears not to have ended it.

    But in Scotland? No idea.
