Planning vs Council tax

Im not sure if this is the right place but if anyone can point me in the right direction I'd be very grateful
I went through planning to convert and extend my garage and the rider on it was it should only be used for stated purpose studio, office and gym - just what I wanted so probs with that.
Then the valuation office of the council decided it was a separate dwelling and banded it.
So my extension is costing me over £200 per month now.
Planning says I can't use it as a separate dwelling and council tax say it is.....
I have an appeal in to the council in July,
any tips please?

    Are you in England or Wales ?

    The planning side would affect how you use the extension but providing the extension meets the relevant criteria to be regarded as a dwelling for Council Tax purposes then it will be regarded as such, regardless of what planning says.

    Your dispute needs to be on the grounds it is not a separate dwelling but part of the original dwelling - the planning side of it is not particularly relevant to this. It may be relevant when the banding is being determined.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
