Claimant asking for more than double , and has not made clear how a breach of terms has happened!!

    The PPC's case is that the driver agreed to pay by performance - the action of parking. This is normal stuff, covered by the Beavis case. They are not saying he/she phoned them up and agreed. We discuss this same thing every week, pointlessly!

    However, the Defendant wants to know if any of the experienced members have ever seen a Claim worded like this. With the Total amount being £252.31?

    About four or five a day. Sometimes they ask for even more.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
    You never know how far you can go until you go too far.

    The defendant has requested a SAR but yet to receive anything back.

    At the moment the Claimant has not mentioned the fact that they have previously accused the defendants car of being parked in a adult and child bay.

    Should the defendant mention this in their denfence or simply base their defence off what the Claimant has wrote in there most recent letter (MCOL)?

    I know the answer must seem obvious to some but the defendant is unsure.

    When did you submit the SAR? PPCs have 30 days to respond to a SAR.

    Yes but that date will be to late for the defendant to submit their defence.

    Hence my previous question.
