Quickquid Advice

My friend got a loan ( pay of next pay day ) He couldn't pay it, so made arrangements to pay them monthly. In October this year he sent a email to quickquid asking if it was finished. he got a email back. See below.

To him he has paid it off and in my eyes also. Anyway he gets a email from quickquid on 12/12/2012 saying this.
As we have advised you previously in the Notice of Default, you have failed to make payments required under your Loan Agreement with QuickQuid or to contact us to take corrective action.

He received a letter from arc which he has replied to by email with the email from quickquid to them.

Can anyone offer any advice as they are saying he has 7 days to pay up or it will be passed to a solicitor. I don't think he has received a notice of default unless he got it when he couldn't pay it off last year?

    Hi there

    First thing first -ARC is a Debt Collection Company (DCA) they are not Bailiffs and they cannot come round to your property and remove your belongings.

    To say you have to pay within 7 days otherwise it will be passed onto a solicitor is normal practice, usually in house firm, but it is an empty threat

    Write a letter to ARC stating you dispute the debt on the grounds you have mentioned and you will not be making any payments until the dispute has been resolved including that of a complaint to the Financial Ombudsman Service

    Write a letter of complaint to Quickquid. You have to allow Quickquid 8 weeks to respond to your complaint. If you are not happy with Quickquid response you can make a complaint to the Financial Ombudsman. The Financial Ombudsman can take up to 9 months to look at your complaint. While in dispute you can block any enforcement action they take (Normally registering a CCJ)

    While you are in dispute write to Credit Reference Agencies ensuring a note of dispute is registered against the debt

    Thank you for your email.

    Please note that ARC (Europe) Ltd is a debt collection agent, acting in good faith on the instructions received from a disclosed principal, namely Quick Quid. We confirm we received instruction from our client on 11 December 2012 to contact you regarding a balance of £212.52.
    However, please be advised that your account is now on hold as we have passed your comments and information contained in your email to our client and are awaiting further instructions.
    We will contact you in due course with their reply.


    He also sent a email to quickquid with a copy of there email saying balance was nil. As of yet he hasn't heard anything back from quickquid.
